O Pristina University tender for legal violations, contract cancelled overall

The lack of full specifications, information on brands of producers, technical characteristics and quality of products constitutes flagrant violations of tender demands and public procurement rules. In this way, the offer cannot be considered reliable and valid to be assessed, as it is impossible to verify the compatibility of products offered with the required technical criteria. The submitted Catalog is incomplete and unclear, creating deep uncertainty about the quality and compliance of products, and therefore makes the offer a fair, objective and accurate assessment of the” impossible, the decision says.

“For all the reasons mentioned above, we urgently demand that the Accounting Authority turn this activity into re-evaluation and pronounce the winning bid only that meets the full and exact requirements of the Tent File, respecting the principles of legitimacy, transparency and equal treatment” is further stated.

According to O decision KPS, University of Pristina has the obligation to report on actions undertaken concerning this procurement activity, otherwise O The Monday may take legal measures for failing to implement the decision.

“In 10 days' time, AK should inform O The EPS for all actions undertaken regarding this procurement activity, on the contrary, O The EPS has the right to take measures against the AK for failing to respect the decision as envisioned with the provisions of Article 131 of LPP”, the decision says.
