“The deputies that had the most votes must not accept the” mandate

With the outcome of the December 28th extraordinary elections and the recounting of candidates' votes for MPs, many irregularities emerged, with many candidates added votes, and several others lifted them. Although no MP who came out with the most votes did not resign, members of the Civil Society estimate they should leave the Assembly on their own.

Eugen Cakoli, in a proposal for Metro newspaper, said their departure could make the respective parties themselves, broadcast Periscope.

And I believe that, in fact, for moral prism, since legally, as long as the same don't have a judicial decision that shows that they've been involved in misusing votes, it's not that they can be granted a mandate, but morally, they should either leave the candidates themselves in question, especially some of them, who differ in votes with thousands of soos, until there's clear. Or the other one, if the parties were really interested in the principles of electoral integrity, that the same people would ask or ask for at least to remove from the structures, since I believe it doesn't contribute to the Assembly, and, in fact, undermines the public's confidence in the representative role of the Parliament, if we have elected MPs who came there with a part of the vote, which either resulted or are actually misused. Therefore, I believe that in this prism it would have to be for candidates, as the best solution, to leave themselves so that there would be no need for exceptions or similar”, Cakolli said.

MPs who secured seats, despite vote manipulation, the mandate cannot be obtained either, as judicial processes last too long.

“Under the law on general elections, Constitution and Constitutional Court judgments, if the appointed deputies receive the mandate, regardless of doubts, they need to be punished by the court form, at least by appeal, with at least one year's effective prison terms, so that they can stop the mandate automatically. But, given the length of the court processes in Kosovo, I do not actually expect such acts to take a firm form within a quick period, since they usually take years of”, Cakolli said among other things.
