Berisha's defender, lawyer Teuta Xhema, said the request has been made due to suspicion of lack of impartiality, reports the “Justice Trust “.
“During the preliminary review, exercising the task of presiding over the court not only because it has not implemented the articles of the Penal Code, which obliges it to prove guilty and guilty evidence, but has distorted material and personal evidence”, Xhema said.
The request submitted for the court's exception contains 15 pages.
Judge Naman asked what the legal basis is after adding that Berisha himself had earlier submitted disciplinary requests to her, but that has been rejected.
For this, lawyer Gemma said the legal basis is suspicion that Naman has shown partiality as head of the court.
