In February 2023, when the Kosovo Energy Corporation (KEK) was still headed by Nagip Krasniqi of Prime Minister Albin Kurti's party, had announced a tender for electricity trade through exchange.
The call was public, then the companies they offered called for negotiations.
The value of this tender, at the end of the announcement that the winning firm was chosen was not mentioned, but the name that appeared in the document was “Noa Energy Trade”, owned by businessman Gentian Sula.
The media have reported on the connections of this well-known Greek energy company and businessman Georgios Peristeris, whom he himself met with Prime Minister Albin Kurti.
KEK's call for the tender had been answered by several companies, who even submitted their bids.
“Noa Energy Trade”, according to documents administered by the Commercial Court of the Republic of Kosovo, all at first had failed to convince KEK, and it went so far as to be considered irresponsible at the beginning.
But in the last few moments, the whole situation would change in favor of this company.
Although irresponsible at the outset, KEK negotiators -- then run as a 100% stake company by the Government of Kosovo by Vetevendosje man Nagip Krasniqi -- invited the Gentian Sula business to the latest stage.
He got paid by contract. Other firms' denture polls were dismissed. And all that was left to companies was to look to the Court.
One of them has done it, and the Commercial Court, with final decision, has ruled that the KEK illegally awarded the tender to the power dealer from the Republic of Albania, Gentian Sula.
What's in the trial's decision?
The Commercial Court, on the first scale, had ruled that the granting of the tender for “Noa Energy Trade” contradicts the applicable laws in Kosovo, and as such is required to be annulled.
The decision has confirmed the second and same court level, rejecting KEK's complaint as groundless.
“By reducing minimum demand for bidding, AK (KEK) has acted in opposition to the Electric Energy Exchange Procedure, taking into account that Article 18 of this procedure assigns the minimum requirements that should be part of the tenders in any tender procedure, but despite that it stresses that the indictee had acted in opposition to the specified criteria for assessment on the Ofers, since it originally disqualified the bidders that failed to meet the legal and administrative conditions, as required at the base of the 8th Energy Trade Strategy Act.”, said in the Qyqi decision.
The court also uncovered the scheme of how KEK acted, which at the time had Nagip Kasnicin, now with two charges for his period at the helm of this corporation, confirmed indictment in the trial that Kosovo Special Prosecutor (PSRK) established.
The process of date 03.02.23 reveals that KEK, “despite having declared Sula's firm irresponsible, all three companies in the race, however, have invited them to negotiate the price, and “in this case has been declared winner “Noa Energy”, which in the first phase was declared irresponsible”, says the verdict.
“... the indictee (KEK) has acted in opposition to the Electric Energy Exchange Process and the Electric Energy Law, since it had to only invite economic operators (OE) to negotiate, rather than offer irresponsible OE opportunities, and much less to announce winner”, states the Commercial Court.
The court has discovered further in the decision that for this tender in the race it was also “GEN-i”, interconnected signature Martin Berisha, Kosovo's ambassador now to Croatia, for whose ties to the branch of this firm in Belgrade and its financial ties.
But the decision says neither “Noa...” of Genian Soula, nor “GEN's” wasn't all right with letters in this tender.
“Procesverbal of opening the bids of 25.01.23, the court finds that the part of the bidding has been five OE, of which only the plaintiff and OE Lonico LTD have been offered according to request, while the OE “Noa Energy Trade”, “EMT Energy” Sh.p.k. “G Eni-I” D.O.O. Slovenia, have not been offered on request”. It says in this document.
Despite the violations, there is no public announcement whether the Court's decision demanding the annulment of the decision KEK handed the tender “Noa Enegry” to Genian Sula.
“Noa Energy Trade” was licensed by ZRE on the date 02.12.2021, just a few months after it was registered as a business in the Agency for Registering Business in Kosovo (ARBK).
In 2022, according to data that this company reported to the Ministry of Finance, the Kosovo Financial Reporting Council, respectively, realised annual circulation of 54m euros. In the next two years, circulation tripled, in 2023 amounted to about 142m euros, and in 2024 ʹ to 161m euros. Data for 2024, provided by the Data4x platform.
In Albania, the “Noa Energy Trade” operates as an electricity trading company since 2014. It is known for contracts with the Albanian Electronic-Energy Corporation (KESH).
The authorised representative for Kosovo is Gentian Sula, a businessman from Albania, more known as the head of a insurance company in Albania. The company has not responded about the experience in electricity trading and engagement in Kosovo's energy sector.
Noah of Gentian Sula and Vuk Hamovic
The business report with the Greek company is not just one of the suspicious collaborations of Gentian Soula's Noah Company.
His company is allegedly linked even to Vuk Hamovic's business, named as one of the regional electricity trade criminals.
Hamovic's EFT company in Albania and Kosovo is the same businessman.
Part of EFTA in Albania is his family family member Suada Uruci. She's married to Jonian Anton.
Jonian is the brother of businessman Gentian Sula's wife, owner of “Noa Energy Trade”
Soula has provided an answer to the “Economic Bulletin”, where she has talked about family ties with leaders in Albania and Kosovo of Vuk Hamovic's EFTA.
