Appeal confirms the liberation act against four airport officials “Adem Jashari”

The Court of Appeals has confirmed the Constitutional Court's decision in Pristina, which had acquitted officials of the “Adem Jashar”, Faton Gurguri, Andy Buyupi, Visar Jackie and Martin Biserov-Alekov, who were charged with misuse of the official position.
The founder had declared the indictment on March 7th 2025, stressing that it had not been proven that the accused had committed the criminal act they were in charge of, reports “Justice Vought”.
Towards the Foundation's decision, the Constitutional Prosecutorate in Pristina, the Randa Crime Department, had filed complaints because of the essential violation of the law and the wrong confirmation of the actual situation, proposing that Apelni plead guilty to the accused and condemn them by law.
Through the complaint response, defenders of the accused Martin Biserov-Alekov had stressed that the act of prejudice is fair and legitimate and that the actual situation has been proven completely.
Appeals Finding
According to Apel's decision, the first degree act is not included in alleged offenses of the criminal procedure for the fact that the device is clear, understandable, and in full compliance with reasoning.
According to Appeal, the prosecution in the complaint had generally mentioned the misconception of the actual situation, but it did not stress concrete cases when the Founding Father has wrongly confirmed the actual situation or any evidence.
In Apel's decision, the Foundation is said to have administered all the evidence, and as a result, it has found that the actions of the accused fail to meet the elements of the criminal work they were charged with.
The appeal stresses that the criminal act “Kestum use of official position or authority” can only be carried out by official persons, while the accused do not enter the category of official persons, while the “Adem Jashari” is managed by a private company.
For these reasons Appeals decided to confirm the foundation decision.
According to the indictment filed on April 2, 2020, accused Faton Gurguri, Andy Buyup, Visar Jackaj, in the quality of official licensed operators for X-Ray and accused Martin Biserov-Alekov, in the quality of electronic engineering and in the quality of automatic overseer at Pristina International Airport “Ydem Jashar”, had misuseded the official post.
The indictment says that on August 18th, 2019, until the attack of workers at this airport, in the area where two LRDX1 and LRDX2 devices had been monitored for the passage of passenger luggage, accused Gurguri and Buyup had not monitored the equipment work on the monitor, while Jackaj had not monitored the sterile airport area to evacuate the suitcases.
Because of these inactions, it is said that the luggage had resulted as suspects from top equipment, with devices being blocked by luggage and in the absence of X-Ray operators.
According to the prosecution, accused Biserov-Alekov, as supervisor of equipment moving to the airport for carrying suitcases, had intervened by opening the barrier and letting the luggage pass through the V device IS HR, which only goes into operation in reserve cases.
Thus, the indictment says 99 luggage had been passed this way by being loaded into the warehouse of the plane by accused Bisserov-Alekov, both suspected and contaminated, and six separate luggage, suspected, which had to be re-checked by the X-Ray operator.
The four accused in these actions, according to the Prosecutor, had risked the lives of passengers and crews, civil aviation security and the image of the Republic of Kosovo in the international arena.
The prosecution charged the four accused that, in co-ordination, they committed criminal work “to use official position or authority”. /Betimy for Justice
