Prime Minister Albin Kurti has been sentenced for the second time to 250 euros in fines by the Constitutional Court in Pristina, after refusing to give his testimony to the Special Prosecution in connection with the state reserve scandal.

According to report Callos, Prime Minister Kurti has been sentenced for the second time, broadcasts Periscope.

Following his first failure to receive his testimony as a witness, the Special Prosecutor had again submitted the invitation to Kurti and the court had issued a warrant for presentation, but Kurti had refused. He has again been sentenced to 250 euros in fine.

Paparac has tried to get information from the Constitutional Court in Pristina, but until the publication of this news, he has not yet received answers.

The Pristina court at 04.03.2025 had issued orders to Kurti to appear in the prosecutor to testify concerning the state reserves case.

Special prosecutors have warned Prime Minister Kurti that in the event of unreasonable failure, he will be forced to appear and that in the event of another refusal, he could be fined or imprisoned.

At the invitation sent to Kurt on December 10th, the Special Prosecutor informed the witness that presenting a witness is a legal obligation.

This obligation is introduced to Article 132 of the Criminal Procedure Code.

“Supporting Article 132 of the KPP, your unreasonable failure will be a reason to force you to appear and you can be fined up to 250 (two percentage points) Euro for any denial. If you appear, but after the consequences have been made known, refuse to testify without legal justification, you can be fined to 250 Euro”, says the completion of Kurti's invitation.

If, after this fine, you refuse to testify, you can be imprisoned. Prisoning lasts until you refuse to testify or until your testimony becomes unnecessary or until the procedure is completed, but no more than a (1) month”, the Special Prosecutor's invitation was said.

The Penal Procedure Code decidently says the witness can be brought under compulsion, by the court's order, if he does not respond to the regular call and if he does not reason on his failure to appear.

“When the witness who has been called in order does not appear, and does not reason, or without permission, and the reasonable cause leaves the place where you should be asked, the judge of the preliminary procedure under the official duty or request of the state prosecutor may force the witness to appear”, says in paragraph 1 of Article 132 of the Penal Procedure Code.

If even after the court is issued, the witness does not appear, then he may be fined up to 250 euros, according to the Criminal Procedure Code.

“If the witness doesn't appear, the pre-procedure judge condemns him with fines up to two hundred-five-five-five-five-0) Euro for each time it doesn't show up. If the witness continues to refuse to testify after being fined, he can be imprisoned as envisioned in paragraph 2 of this article”, says Article 1 of the code.
