AGK welcomes the collapse of KPM Law by Constitutional Court
The Constitutional Court has announced this Wednesday that it has abolished the 08/L-289 Law for the Independent Media Commission, after finding some of its provisions in opposition to the Kosovo Constitution.
The trial found that Law No. 08/L-289 for the Independent Media Commission must be abolished and the same be revised based on the findings of Action”, the media report said.
Some of the crimes found have to do with the way members are elected, the chairman's dismissal, KPM competencies and others.
The Kosovo Journalists' Association, along with the media lawyer, Butteran Kusari had sent the opinion requested by the Court for This Law, and welcomed the decision to abolish, believing that a new law, with debate and widespread public involvement, and in line with European standards, is needed, respecting the Council of Europe recommendations.
The main part of the announcement of violations is this:
The court, unanimously, has decided (i) to declare acceptable demands; and (i) to state that, sub-paragraphers 1.2 and 1.3 of paragraph 1 of Article 15 (The election of controversial KPM members) of the Law are not in agreement with Article 141 [United Councils Commission] of the Constitution; (ii) to establish that, under-paragraphers 3.4 and 3.5 of Article 3 (Design of Chairman and Prophetship) of the Conflict Law, are incompatible with Article 7 [Vellars] and 141 [Decilators] of Article 18 (VVENTS), minus 2,5 points, 5th CENTURS, and 3-rays of the paragraph, and 3-rays in the 3-rays in the 3-rays; the 3-rays in the 3-rays and the 3-rays of the 3-rays are not in the 3-rays of the 3-rays of the 3-rays, the 3-rays and the 3-rays of the 3-rays, the 3-rays of the 3-rays, the 3-rays are notch-rays of the 1-rays, the 3-rays of the 1-rays and the 3-rays of the 3-rays are notch/Periscopi/
