The Constitutional Court in Gjakova has pronounced a free trial against Deda Llesh on charges that on July 12, 2003 in Raça Gjakova, N.N. has been deprived of life.
In this case, Deddy Llesh, who was extradited by the US, was charged with being shot 28 times in front of him on July 12, 2003 in Raça, Gjakova. The murder reportedly occurred after the late man had now killed the father of the accused 12 years ago, reports the “Bet on Justice”.
The judgment against Lish was announced Friday by the chairman of the court, Ilir Raskaj.
Judge Raskaj said that in the absence of evidence under which it would be proven that the accused committed a criminal offence, the Court has taken on a free trial.
The injured in implementing property-juridical demand are directed in civil disputes.
Against this trial, the parties have a 30-day complaint at the Court of Appeals.
Otherwise, according to the act of Basic Prosecutor in Gjakova, founded on April 18, 2024, Dede Llyesti was charged with being accused that on July 12, 2003, in the village of Raça of the Gjakova municipality, near the “store. V-Shala” has deliberately deprived life now of the late N.N., (47-year-old). The case is said to have occurred because of the murder of his father, P.L., who was deprived of N.N. 12 years ago.
In the indictment it is said that on the critical day, the defendant Llesh now goes upstairs with his car, conveying the movement of now the late N's move, when the latter has entered the shop to buy food, defendant Llesh awaits him, as soon as he notices he leaves the shop, from an vicinity shooting him 28 times in different parts of the body.
Even when the victim falls to the ground, defendant Dede again shoots at the victim's head, damaging the entire left side of his face, and causing multiple gunshot wounds to the head, chest, and limb, and wounds suffered by the victim have remained dead at the scene.
For this, it was accused of committing criminal work “murder” by Article 30, par.2 points of LPK.
In reasoning on the indictment, defendant Deda Llesey is said to have been on the run from the time he committed a criminal act. He has been arrested on international warrant and extradited from the US to Kosovo. The indictment reportedly on February 7th 2024, on the part of police officials has reportedly been extradited by the US defendant Llesh, and brought to Pristina Airport and later to the ban at the police station in Gjakova.
It says that after the defendant was earlier on the run, the Constitutional Prosecutor in Gjakova, on February 8, 2024, had made a decision to resume investigations into illegal murder and possession, in connection with the murder that occurred in 2003 and a request for detention has been submitted. Later, the same was assigned detention measures.
According to the indictment, during the investigation procedure, it has been confirmed in general that defendant Deddy Llesey has committed criminal work “Vrasje”, while in terms of criminal work “maintaining without authorization of weapons and ammunition” from Article 8, par.8.5 related to par.8.3 of UNMIK's 2001/7 regulations, has come to the conclusion that the absolute term of the criminal prosecution's prescription has passed, after more than 20 years passed from the timing of carrying out of the criminal work.
So, given these circumstances and the above-mentioned facts, we've received a ruling on the partial firing of investigations, against defendants Dede Lleshi, due to the criminal act of keeping arms and ammunition without authorization from Article 8 par.8.5 related to par.8.3 of UNMIK regulation 2001/57.
