Innocent War Crimes Indictee Declared in Gjakova

Initially, since the February 4th 2025 hearing was postponed at the defence request, because it was not equipped with all the subject papers, the chairman of the Lufi Shala Court asked whether the prosecution has fulfilled its obligations to hand over the paperwork.
In this regard, prosecutor Memaj said the prosecution has handed all the subject papers to the defence and that the same has no remarks.
The procedure informs the Court that it has met all legal conditions for delivering evidence that have been under way for translation”, Memaj said.
And defendant Shujak's defender, lawyer Ljubomir Pantovic, said he has accepted the subject's papers from the prosecution, but that his client has not yet been handed over to the indictment.
It's true, Mr. Chairman, I took the subject papers yesterday and I have no remarks, but I have remarks on the fact that the alleged defendants have not yet been handed over to”, said lawyer Pantovic.
After the defense presented no problem, however, the hearing continued with the reading of the indictment by prosecutor Memaj.
Presequently, Memaj said that several technical improvements have been made in terms of the actacise device, so that in the first line of the device, instead of the word “the victims of the Gjakova municipality”, from now on it will be “in the entire Gjakova”, as well as at the point of one device, following May 10, 1999, the <x4th> on the Curriova Bayram Curi street to Gja”.
In contrast, according to the indictment filed by the Special Prosecutor of the Republic of Kosovo on 24 January 2025, defendant Jusuf Shujak is charged that during the 1989-1999 time course, in Gjakova, during wartime in Kosovo, in co-ordination with other members of Serbian police and military forces, deliberately violates the rules of international law against civilian persons, namely Article 3 of the Geneva Four Convention and Article 4 of the additional Protocol II, committing murder, deportation, and destruction of the ever - lasting wealth of the civilian population.
According to the first device of the indictment, accused Shujak, on May 10, 1999, along with other members of the Serb police and military forces, unified and armed and divided into various groups, enter the house of the M.D., in which only M., B.D., his wife, a child and two displaced, C.H.H., and I.L., who were temporarily accommodated, orders them to come out, except for the M.D., who had remained inside the house. Once in the courtyard, Serbian policemen stop C.H., and I.L., asking for IDs and then addressed “ah you are KLA” and were immediately shot at, killing them both. Another policeman comes into the house, including M.D., shooting and killing him.
Always according to the indictment, the second device says that at the time and place described as in the first disposition, Serbian police and military forces, by force and under threat of weapons, expelled the Dyla family from their homes, in a way that on the day of the incident until members of the Serbian police and military forces had entered the house of M.D., leaving them and two others dead, while the rest of the family forced them to leave their home and to unite the columns of civilian residents of national Albanian nationality and other national nationals, with violence and blood.
In the third device of the indictment, however, it is said that the defendant Shuyak, along with Serbian police and military forces, looted and destroyed the Dula family property, in a manner that on the day of the incident, after killing and driving out the victims described as in the first and second device of this indictment, originally robbed the Dula family house, and several other houses around it, and finally burned them, causing the victims huge material damage.
In this regard, Yusuf Shuyak is charged with committing a co-ordination criminal act “wage war against the civilian population”, and sanctioned with Article 142 about Article 22 of the Penal Law of Is h - RSPJ.
