Witness says accused Akek was the main initiator for burning his four homes

Witness Sadri Jashari during the testimony in the trial process to Cedomir Akek, who is accused of war crimes in the Shtime municipality, said Akek was the principal initiator who had four houses burned during the war period. Said the accused was the police command. <x0)
“The number one initiative was Ceda (refering to accused Cedomir) that they had it behind them in front of them, and that they had the police command”, said the Jashar witness, reports “Justice Vought”.
Asked by the special prosecutor, Habibe Salihu, who the person was, the witness said he was exactly the accused Cedomir and that by that name he was called as their neighbor.
Also, Jashar said only his family's houses had been burned and that the reason for this was that one of his brothers was a member of the Kosovo Liberation Army, which was reported to the accused Akek.
The Witness Jashar said that the accused's father and brother had good neighbourly reports but not even with the accused Aksim, since he never spoke to them even though they were close to home.
To burn houses, the witness says he understood it from his neighbors and that they themselves had shown him that his homes had been burned at the order of the accused Akek.
For the accused, Jashar said he saw him personally dressed in police clothes.
However, Jashar said there were no problems before this case with the accused and that their houses had been burned after the Recak massacre had occurred.
Similarly, prosecutor Salihu gave the opening word, saying they are a considerable number of witnesses and material evidence speaking of the prosecution's participation in crimes committed.
At the same time, Akek's defender, lawyer Zarko Gajic, said he would ask the court to provide documentation from the institutions in order to clarify the personality of the accused Aksic as to whether he has ever been contrary to the law through his actions.
Otherwise, on November 20, 2023 at the Constitutional Court in Pristina, there was the failure of trial against indictees Cedomir Aksic, who is being charged with war crimes. The lack of judgment is envisioned with the New Code of Criminal Procedure of the Republic of Kosovo.
The Special Prosecutor of the Republic of Kosovo (PSRK) on May 4th 2023 has filed charges against Cedomir Akek, who is accused of war crimes in the Development Community, specifically in the villages of Recak, Mulapolc and Petrov. He is charged that since January-May 1999, by interacting with a group of uniformed criminal people, they have caused great suffering or violation of body integrity or health and fear of the civilian population.
In the indictment, it is said that at the point called “The Shooting Framework” country between the villages of Recak, Mulapolc and Petrova, along with other members of the Serbian forces, had ordered the expulsion of residents of the neighbourhood, and then along with other members of Serb forces, burned the homes of the injured, causing moral and material damage of up to 300 thousand euros.
In the place called “The Lugu of Nash”, in Petrova Shtime, Akek is said to have now executed the late Halil Hyseyan with a ten-pound rifle, where the family of the deceased had been stopped by the accused Akek, where the same had later found the body of the deceased without life. And in the village of Recak, Akek was said to have participated in the murder of Hajriz Brahim, Hakin Murati, Sabri Murati, Arif Murati, Ahmet Mustafas, Sadik Mujota, Skender Halit and Hanumshahe Mujota.
Initially, Akek was said to have been co-ordinating with the other Serb forces, shooting toward Hajriz Brahim, while the latter was fleeing from his house towards the mountain, and after Hajriz Murat, Akek was said to have shot at Hakin Murat, Sabrin Murat and Arif Murat. On the other hand, in the presence of the woman (the victim), Akek was said to have killed and the person named Ahmet Mustafa and as he was leaving the home of the late Mustafa, with Serb forces reportedly fired even in the direction of Sadik Mujota, Hanumshahe Mujota, Skender Halit and Mehmet Mustaf.
Random Witnesses are listed: Ruzhdzhi Jashari, Sadri Jashari, Rizau Union, Shukrije Hysenaj, Agim Hysenaj, Hajdin Hysenaj, Blerim Hysenaj, Hyzer Hysenaj, Suyota, Tefik Halili and Avdullah Krasniqi.
With these actions, Akek is accused of committing the criminal act “wage war against the civilian population”, punished by Article 142 of the Criminal Law of the former Socialist Republic of Yugoslavia, currently punishable even under the Geneva Convention as “War Crime” in grave violation of Article 3 of this convention and Article 4. Protokoli 2 on 8 to 1977 and currently punishable under Article 146 and 147 of the Criminal Code of the Republic of Kosovo.
We remember that the trial process against Akek takes place in absentia, since the Prosecutor and Court have seized every opportunity to ensure his presence in court.
