The prosecution demands that the case against the two police officials be turned into retrial

Mitrovica's Constitutional Prosecutor has demanded from the Court of Appeals, that the case against police officials, Rrustem Mehmeti and Teuta Mulliqi, who are accused of mistreatment during the task, be annulled and the issue be turned into retrial and re-retrial. The prosecution via the complaint claims that the Constitutional Court of Mitrovica has made a false confirmation of the actual situation regarding the acquittal of accused Mulliqi's charges, since evidence management proves the same has committed the criminal work for which accused Mehmeti, the prosecution has complained to the argument that the conviction pronounced has not been adequate for the weight of criminal work and the consequences caused, reports the “Bettim for Justice<1>.
In addition, against the Foundation's decision, the complaint has been filed by the defender of accused Mehmeti, lawyer Gazmend Smajli, claiming that the first degree court has wrongly condemned his defense and that, according to him, he has failed to prove that he has committed the same criminal work, demanding that the first degree trial be annulled and that the case be turned into retrial.
The chairman of the court, Judge Ferit Osmani, later announced that the parties will accept this court's decision within the deadline.
Otherwise, the Constitutional Court in Mitrovica on September 23rd, 2023 accused Rrustem Mehmeti had pronounced the sentence of 3 thousand euros in fine for criminal work “Kest treatment during the exercise of official duty or public authorization”. While accused Teuta Mulliq was acquitted.
The Constitutional Prosecutor in Mitrovica on September 20, 2021, has filed charges against Rrustem Mehmet and Teuta Mulliq, arguing that on August 24, 2020, at the office of the Police Station in Mitrovica South, with abuse of office or authorisation they have abused, feared and seriously offended the dignity of the other person, the N.B.
According to the indictment, on the case of questioning the N.B. in Teuta Mulliq's office, since the same had asked him to clarify for what reason he was invited and told him that he did not want to issue a statement without a lawyer's presence, they have not read his rights to the accused, while the accused have begun to pressure and physical violence to make a statement.
In addition, the indictment says the defendant Rrustem told him: “Which lawyer is loving, Toma or Rhecaj, what are you, teachers like you have brought us here where we are now”. About an hour, however, no lawyer was provided.
All in accordance with the charge, defendant Rrustem Mehmeti had twice hit him in the back of his neck, committing physical violence, while the defendant Teuta was ironicly smiling.
On the other hand, it is said that the policeman Rrustem had put his hand on his mouth and told him that he would break his teeth or bones while the entire event was damaged by the N.B. He recorded it with a mobile phone.
Therefore, this charges that, in co-ordination, they committed criminal work “Consideration during the exercise of official duty or public authorisation”, by Article 195, par.1 of KPRK, in connection with KPRK Article 31.
