The Constitutional Court in Pristina has made the decision with which it approved the agreement linked to the Intermediation Centre between Deputy Prime Minister Besnik Bislimi and deputies Hajdar Beqa, Bekim Haxhiu and Mergim Lushtaku, for the clash in the Kosovo Assembly on 13 July 2023.
The decision was made on September 2nd, 2024, through which the court has also rejected the indictment against Bislim, Beqas, Lushtak and Hadziu, and has stopped criminal proceedings against them.
“HU ANDT the PTH indictment in Pristina-General Department, PP. II.nr.4413-23, dt.24.10.23 and PUSHAHOUS criminal proceedings against defendant B. B., M. L. and H. B., due to the criminal offence attack by Article 184 par.1 of KPRK, for defendant H. B. Even because of criminal acts of extermination, or damage to property by Article 321 par.1 of KPRK, while for defendant B. H., due to the criminal offense, slight bodily damage from Article 185 par.1 points 1.4 points of KPRK”, says the court's decision, which has provided “Justice Voct”.
On the other hand, this ruling says that the agreement reached between the upper parties has been approved in carbon article 248 paragraphs 1, chapters 1.4 of the Penal Procedure Code regarding Article 2 paragraph 2 and Article 15 paragraph 1 of the Law for Mediation.
The reason for this decision is said to be that for the indictment filed against Bislim, Beqes, Lushtak of Haxhi, the court on May 25th 2024 has scheduled and held the initial review, where, with the proposal of the parties in the procedure, it is decided to be sent to the Centre for Mediation in Pristina, where and at this centre the agreement has been reached between the parties in the procedure.

That such an agreement had been reached between the parties, on August 14, 2024, the PDK MP's lawyer, Mergim Lushtak, Besiana Ismajli, had confirmed.
By this agreement has come after the May 28, 2024 session Faithful Bislim, Mergim Lushtaku, Hajdar Beqa, and Bekim Haxhiu had agreed that this issue be settled in mediation.
The agreement of the parties for the matter to go into mediation procedure had come after the case judge Erol Gashi proposed it.
The defender of accused Besnik Bislimi, lawyer Florent Latifaj, has said that after consulting with his defence, they agree that this subject will go into mediation procedure.
Even the defender of accused Hajdar Beqa, lawyer Hajzer Salihu, had said they would give the mediation procedure a chance.
Likewise, the defender of the accused Mergim Lushtaku, lawyer Besiana Ismajli, had backed the statement by lawyer Salihu, who said they agree that this subject will go into mediation.
Also, the defender of accused Bekim Haxhiu, lawyer Ardian Megyan, had agreed that the subject would go into mediation.

What was Deputy Prime Minister Besnik Bislim accused of?
According to the indictment, Kosovo Deputy Prime Minister Besnik Bislimi was charged that during the July 13th 2023 plenary session, he used physical force against the now injured deputy of the Democratic Party of Kosovo (PDK), Mergim Lushtaku, after he had watered Bislim.
According to the prosecution, Lushtaku had done so in protest after accused Bislimi had previously removed a photo of Prime Minister Albin Kurti presented in the form of “Pinochios”, set in advance by several MPs. After throwing water at the prime minister and then Bislim, it is said that Biselim had shot Lushtaku with bottles and then deliberately hit him with fists on the face of the injured Lushtaku, action seen by security cameras inside the House Hall.
With that, Bislim was accused of committing criminal work “Attack”, according to Article 184 par.1 of the Penal Code.
What was MP Mergim Lushtaku accused of?
According to the indictment, there is doubt that defendant Mergim Lushtaku on July 13, 2023, at the site of the Parliament, during the establishment of the regular plenary hearing, has used physical strength against the now-inhibited Bismli. It says that after the creation of the situation on the site, defendant Lushtaku had deliberately attacked Biseli, striking him in the face, actions seen through security cameras located inside the House Hall.
With that, Lushtaku was accused of committing criminal work “Attack” under Article 184, partner.1 of the Penal Code.
What was MP Hajdar Beqa accused of?
As for defendant Hajdar Beqa, deputy of the Democratic Party of Kosovo (PDK), it is said that on July 13th 2023, at the site of the Parliament, during the plenary session, he used physical strength against the injured now, Finance Minister Iron Murati. According to the indictment, until the injured Murati had seen MP Lushtaku throw water towards the prime minister of Kosovo, the same was set up to prevent an attack on the prime minister and then the defendant had deliberately attacked the injured Murati, punching him in the face over the eye, actions seen through security cameras in the Parliament.
By that, Beqa was accused of committing criminal work “Attack”, from Article 184, par.1 of Penal Code.
The indictment states that the defendant Beqa, on July 13th 2023, in the object of the Parliament during the plenary hearing, revolted from the situation created between PDK deputies and some members of the government cabinet, deliberately causing material damage to the injured Iron Murati, the same hardy from his face has pulled his glasses, then throwing them to the ground, damaging them, causing them damage to indefinite value.
With this, it was accused of committing criminal work “Nothing or damage to property” by Article 321, par.1 of the Penal Code.
What was MP Bekim Haxhiu accused of?
Always according to the indictment, Democratic Party of Kosovo deputy (PDK), Bekim Haxhiu, was charged that at the Assembly session, on the same date, he had used physical strength, to the now injured Hekuran Murati, this following the situation created between MP Mergim Lushtaku and members of the government cabinet. According to the indictment, the defendant Haxhiu, deliberately inflicting bodily injury on the injured Murati, has punched him to the left of his face, causing a jaw - spraining of tissue, qualified injuries as mild bodily injuries.
With these actions, Haxhiu was accused of committing criminal work “light bodily access”, according to Article 185, par.1, measure 1.4 of the Penal Code.
With this indictment, it has been proposed that during the management of the evidence be released and looked at as evidence: a CD with videos-incipulations from the Parliament, a video-incipulation CD from the Parliament on July 13th 2023, a video-inciation CD received from the DIA regarding the case of the Parliament, photo-documentation that is found in the subject papers, statements of defendants and injuries, and information provided during the criminal procedure, the medical report, the medical expert, doctor's expert Dr. Naim Uka.
Through the indictment filed by prosecutor Nebahate Salihu, it is proposed that after maintaining public trial, defendants be convicted and sentenced according to the Code and the same be obliged to pay the costs of the criminal procedure.
