Charged on firefight in Kacanik Court object

The disgruntled parties against this decision, within the 30-day deadline, have the right to complaint through this court at the Court of Appeals.

Similarly, at the session held on the same day, the final word was given by special prosecutor Fikrije Krasniqi-Fejzullahu and the defender of the accused Raka, lawyer Fehmije Gashi-Bytyqi.

In her final address, prosecutor Krasniqi-Fyzullahu asked the tribunal for the accused to be convicted, since, according to her, the hearing of witnesses and evidence in the subject documents, it has been confirmed that the accused Raka has committed the work, which is placed on him.

On the other hand, lawyer Gashi-Bytyqi during her final address, said the Special Prosecutor's indictment does not have legal grounds, but according to her it has not exceeded even the level of indifference.

She said there is neither direct nor indirect evidence in this case, and the same request from the court that her defender be acquitted of the prosecution.

According to the indictment filed on June 6th 2024 by the Special Prosecutor of the Republic of Kosovo (PSRK), accused Elmedin Raka deliberately and following the preliminary agreement with minors T.B., M.R. and V. To., with the goal of endangering constitutional order, has destroyed and damaged institutions or public equipment, being with nobly ideological conviction and spreading hatred of the state institutions and laws of the Republic of Kosovo, on March 13, 2024, around 3:42 minutes, have gone to the object of the Ferizaj branch Foundation in Kacanik.

With this, the accused Raka was charged with co-ordinating with minors committing criminal work “Responding constitutional order with destroying or damaging public installations and equipment” by Article 122 over Article 31 of the Penal Code.
