The Constitutional Court in Gjakova has found father and son Enver and Emir Sylka guilty and sentenced them to 36 years in prison (both) for the murder of N.V., in September last year in Rahovec.
The indictment was proclaimed Monday by the chairman of the court, Sultan Dobraj.
According to the trial, accused Emir Sylka for the criminal work of “grave murder” has been sentenced to 22 years and 6 months in prison, while for criminal work “possession, control or unauthorized possession of weapons” has been sentenced to 1 year in prison. To him, the court has pronounced a unique prison sentence in 23 years, the Justice Vow writes.
While accused Enver Sylka of criminal activity “grave murder in pushing” has been sentenced to 13 years in prison.
The accused, in the pronounced sentence, will also be counted as the time spent in custody. The same, Judge Dobraj, indicated that the detention was continued.
The damaged parties have been instructed in civil disputes for realising the property-juridical demand.
In contrast, according to the indictment filed on January 31, 2024 by the Constitutional Prosecutor in Gjakova, Emir Silka was charged with having on September 19, 2023, in Rahovec, deliberately deprived the late N.V. of life now, and threatened the lives of the injured L.V.
In the indictment, Emir Sylka reportedly was working at his bar on a critical day, when called by his father, defendant Enver Sylka, who told him about the fight with the injured L.V., and invited him to go to their property. Defendant Emir took his car and quickly went to the location mentioned above, where Enver, along with the defendant, headed to the injured's door shouting “get out of”. Behind him was the defendant Enver and near the stable the N.V. and L.V. As they approach their court door, defendant Emir began to swear and shout in words “but you want to talk to me now or I'm going to... At this point, the late N.V., picked up a wooden stick and launched an attack.
According to the indictment, in those moments defendant Enver addresses indictees Emir in words “, knee”, and immediately defendant Emir extracts from his belt and shoots four times in the direction of the injured, hitting the N.V., in the breast section, which because of its serious health condition, was sent for treatment at QKUK in Pristina and on September 22, 2023 passed away as a result of the wounds suffered. And the injured L.V. Hit him in the leg, causing serious bodily injuries, and then two defendants quietly drove into their cars and left the scene.
With this, Emir Sylka was accused of committing criminal work “grave murder”, from Article 173, paragraph 1, subparagraph 1.5 Penal Code.
Also, Emir Sylka was charged with illegal weapons, having possessed the Turkish-made gun. SUB Elite 9mm, with whom he committed high-ranking criminal work and held it illegally and without permission from competent organs. By this, it was charged with committing criminal work “ownership, control or unauthorized possession of weapons”, from Article 366, paragraph 1 of the Criminal Code.
According to the indictment, defendant Enver Sylka was charged with deliberately pushing his son, defendant Emir Sylka, to commit criminal work “grave murder” against the late N.V., as well as at risk of the life of the injured L.V.
The indictment says that after a dispute on his property with the injured L.V., the defendant Emir was also informed of the several-year dispute. So, defendant Enver called his son, Amy, telling him that L.V. <x0.EL. And he threatened me that you can't keep working and his brother N.V.” came along. The defendant Emir, equipped with weapons, came quickly with his car and went to the top seat.
For this, Enver Sylka is accused of committing a serious criminal act “murder in pushing”, from Article 173, paragraph 1, subparagraph 1.5 concerning Article 32, paragraph 1 of the Penal Code.
