Aktas assassination: Kush's Freedom Panel had decided to free Vesel Bunjak over two years before serving a full sentence

The panel for Freedom of Conditions consisting of the leading Valdete Daka and members of Burim Ademi and Besim Zlatshi, on July 24, 2024, had made a decision to release Vesel Bunnjak on bail, two years, two months and five days before the end of the sentence. Bulnjak was in pain of punishment because of criminal work “Help [...]
But, just 34 days after his release, the event took place between families “Sekiraqa” and “Gashi”- known as the Capat, where Friday Gashi was dead.
Vesel Bulnjak, has been assigned the 30-day detention measure by the Pristina Constitutional Court on 12 September 2024 under suspicion that he has manipulated evidence in the case of Friday's Gashi murder, following shootings among families “Sekiraqa” and “Gashi” known as the Capat, September 1st in Pristina's “Aktash” neighbourhood. He allegedly concealed two weapons after shooting between the two groups.
But, regarding the case for which he was in distress of the sentence, the panel's decision, provided by the “Justice Trust”, was said to have decided that Bulnjak would be released from July 29th 2024 and be under the supervision of the Kosovo Sprovatory Service until September 29, 2026.
Also, with the approval of the Bunjak's parole request, the same was required that within five days of release from the correctional institution be announced to the Kosovo Regional Police Directorate, respectively, at the Speduling Service under certain conditions.
“1. report regularly to the Sprovatory Service by 2909,2026; 2 in case of the shift in the settlement, let me call the Police and the Sprovatory Service; 3. not trying to travel abroad without the approval of the Treaty for Freedom with Condition 4. be more careful with his future behavior”, says the PLK's decision.
Initially, the panel's decision notes that the Bulnjak on November 30th 2018 had been convicted and sentenced to 5 years and 6 months in prison by the Constitutional Court in Pristina for criminal work “assisting in carrying out the serious murder act” by Article 179, par.1, points 1.4 and 1.6 related to Article 33 of the Criminal Code.
However, the Court of Appeals on March 28th, 2019, had amended the act of first degree in the legal status of criminal acts and the sentence on the sentence, so he pronounced him prison terms for 11 years and 6 months and found that in the actions of convicts remain elements of the criminal act “contributed to the commission of capital offense” by Article 179, par.1, c. over Article 33 of the Penal Code.
Then, reportedly at the panel session, the report of Kosovo's professional corrective Service team was considered, and following the assessment of the data presented in this report, the panel has found Bunjaku, has been sentenced to 11 years and 6 months in prison, and that he has yet two years, two months and five days in prison.
“In the legal report for the convict proves that the convicts, the date of the completion of the sentence, is set at 29,09.26 and by the conviction count, results from the 11-year sentence, 6 months remaining in the 2 years, 2 months, 5 days, which will be monitored and controlled by the Kosovo Sprovatory Service”, the panel ruling says.
The decision says that from reports compiled by the professional team of the Correcting Centre, Bulnjak has shown good behaviour, however, there is no record of new disciplinary violations. Also, this team estimated that the “resocialisation process is reaching”.
The panel during the session found that convicts have twice been denied bail demand.
“From preliminary reviews of parole requests results in the convict improving his behavior, respectively, from the first review of the bail request there is no record of new disciplinary violations. In the data on implementing the programme for the treatment of convicts, it has been found that the convict is a users of holiday outside the institution”, the panel ruling says.
During the application review, the panel has also praised the promise Bulnjak has given to the Sprovatory Service official that he will co-operate with them until the completion of parole monitoring and that with effective oversight the same will easily be re-integration into households and societies in accordance with the law.
In the end, the panel had concluded that the detention had reached the goal of the sentence, as Bunjak had held more than 2/3 of the sentence since November 29th 2022.
So Wessel Bulnjak was released on parole on July 29, 2024 under the conditions mentioned above.
