After the Supreme Court of Specialised Chambers of Kosovo annulled the decision to sentence Salih Mustaf to jail for 22 years, lawyers in Kosovo expect his sentence to be reduced.
According to them, the Supreme Court's decision is expected to affect other cases of treatment by its specialist.
On charges of unlawful murder, arbitrary ban and torture in December 2022 were pronounced 26 years in prison to former KLA commander Sali Moussa from the Special Court in The Hague.
In 2023, his sentence was reduced for four years.
New expectations have given rise to the 22-year prison sentence being reduced.
This was after the Supreme Court of Specialised Chambers of Kosovo annulled the decision a few days ago on his 22-year sentence.
According to the Special Court's accredited lawyer, Taulant Hodaj, this step will be an impact even on the other defendants and convicts there.
The “E issues and gives instructions on which laws should be applied on the case of the height of the sentence because the First Court has set a higher rate of condemnation than it was envisioned with the applicable law at the time, and I said the Supreme One is saying that the penalty should not go through the previous years with the most favourable law that has been in force”, Hodaj said.
Considering the sentence too high and unmanaged, the lawyer, Kadri Ossey, is saying that the possibility to reduce the sentence is too great.
If the second instance court to which this review has been returned avoids the previously pronounced sanctions shortcomings would be much smaller than the one pronounced for the fact that in the concrete case the most favourable law should be applied because by its application, the smaller” sentence will be pronounced, Osaj said.
He even mentions how low he can be.
If the most favourable law is taken into account then the maximum sentence is 20 years and this has never been pronounced so that the sentence cannot be more than 12 to 13 years”, attorney Osaj has said.
The ruling on Sali Mustaf's sentence was the first by the Special Court in connection with war crimes investigations in Kosovo, RTVD reports.
