Former KLA soldiers wanted by Serbia may be arrested in northern Macedonia

The Supreme Court today has ruled over the extradition of former KLA soldier Blerim Ramadani, wanted by Serbia as a war crimes suspect in Kosovo, for which the Constitutional Criminal Court's act in Skopje was cancelled, and the case was returned for a new decision and action. On the other hand, according to the three judges of the Court [...]

On the other hand, according to the three judges of the Criminal Court, there was no basis for the extradition of Blerim Ramadan, who had already escaped from domestic arrest ordered by Judge Pajazit of the same court.

Consequently, this means that former KLA soldiers wanted by Serbia could be arrested in northern Macedonia.

“The Criminal Council of the Department for Organised Crime and Corruption at the Constitutional Criminal Court in Skopje, on the occasion of making the decision he found no legal confirmations have been met for the extradition of the person mentioned. No reasons have been given based on which it was instructed when it acknowledged that the procedure was initiated in accordance with Article 75 paragraph 1 of the Law for International Co-operation in Criminal Affairs, as a cut procedure that would be conducted as regular procedure in accordance with Article 68 concerning Article 51 of the same law. According to the Supreme Court of the Republic of Northern Macedonia, this kind of action and decision-making on the part of the first-degree court is unclear and unintelligible, without the relevant reasons for which the council was led during its decision-making”, the Supreme Court said.

On the other hand, during the retrial, the first degree court has taken into account the related indicators, as well as provisions of the Law for International Co-operation in Criminal Affairs and the European Convention for Extradition.

As SAKAMDAKAZAM reports. MK, Ramadani has escaped from house arrest by relatives' house in Macedonia on 14 August. He was arrested on July 17th, 2024 at the Jazhinca border checkpoint and was sent to the Shutka prison for 30 days of extradition detention.

Serbia is asking him to speak of arrest for alleged crimes in the Kosovo war 25 years ago.

However, the trial judge of the preliminary procedure Pajazi Pajaziti from the Criminal Court in Skopje, due to extradition, Ramadan has assigned house arrest to the registered address of family/friends of the suspect Ramadani. As we learned, Ramadani has fled just after the three other judges' decision in the Criminal Council, who, unlike his colleague Pajaziti, have ordered Ramadan to be appointed 30-day detention measures due to the risk of escape.
