The hearing in the Mitrovica murder trial was interrupted yesterday, family members of the damaged party call it a lawyer, akriminal and a dog.

All of this has happened at the Constitutional Court in Prizren after Halimi has rejected defence side proposals to invite all members of the Commission who have drafted psychiatric expertise.

Halimi has said that only the chairman of the commission, not all members, has been invited to the judicial practice forever.

The lawyer has demanded that the prosecutor and representatives of the damaged side be declared separately as to what is being questioned, and is it a distrust of the body that has drafted expertise.

After those words, members of the damaged side have addressed the Halimi lawyer with the words that “you are a dog”, “criminal”, ” down to the world”, ” that God be in the boy and in the family tani”.

In this case, lawyer Halimi has said he refuses to present at the session unless procedure is launched against all those who, in addition, have threatened him at the hearing.

He has asked the police and Prosecutor to receive the session's videos and immediately initiate criminal proceedings against all those who have made threats.

“Actions that occur within the judicial examination you need to initiate procedure in the Prosecutor is your task”, lawyer Halimi said.

On the other hand, Judge Raima Elez has said the procedure should be initiated by the prosecution.

In this case, Judge Elez has interrupted holding the trial, arguing that order has been violated within the hearing.

This was the initial hearing of the Institute of Psychiatric Experts' Commission, psychiatrist Dr. Arsim Gashi, psychiatrist Blinera Hoxha-Jouraj and psychologist Blerta Vesey but that expert Gashi had previously announced to Judge Raima Elezi that because he was abroad it was impossible to be present during the hearing.

Meanwhile, the damaged party lawyer Abbit Aslan did not agree that this hearing would continue with the reasoning that there was no expert-psychiatrician Gashi missing, and that most questions were first asked to appear to him and that they had requested by the courts that all members of the commission be present, and that this proposal by lawyers was approved by the Court.

In the meantime during the hearing, Judge Ramia Elezi said that for the lack of expert Gashi, he had previously announced prosecutor Genc Nixha and that he had asked whether the hearing could be held even in the absence of expert Gashi.

Meanwhile, prosecutor Nijza had been of reconciliation for this session to be held even in the absence of Gashi's expert, but that the same during the hearing said he had not been aware that they had agreed to question the three experts, and that expert Gashi was meant to be questioned in the first place.

Also, the lawyer of the damaged party, Mehmeti, addressed Judge Elez as her duty to inform the injured side of Gashi's absence because they would not have appeared at the session today.

By contrast, this criminal case, with the decision of the Kosovo Judiciary Council (KGJK) on November 19, 2022, has been transferred from the Constitutional Court in Mitrovica to the Constitutional Court in Prizren. In addition to the case of accused Aslan, this court has accepted eight other cases of criminal nature at the Randa Crime Department.

The Constitutional Prosecutor in Mitrovica, on October 28, 2021, had filed charges against Shefki Asllani, with the reasoning that he committed criminal work “grave murder” by Article 173, par.1, points 1.5 of the Penal Code.

In the indictment, it is also said that as a result of the defendant's shootings, both the injured and the injured, Lutfi Fazliu, as well as the random passerby Agim Abdullah.
