AGK Hands Over to Constitutional Court Comments on Law for Independent Media Commission
The Kosovo Journalists' Association has submitted its comments regarding the Law for Independent Media Commission (KPM) to the Constitutional Court today.
We argue that the procedure followed during lawmaking and provisions regulating the composition and functioning of the commission, the definition of online media and the council of complaints are contrary to the Kosovo Constitution and affecting, among other things, KPM independence, the right to media freedom and the principle of gender equality.
By respecting the tribunal's final decision-making, we consider that relevant provisions should be abolished, and since it is impossible for the controversial law to survive the abolition, we propose to the Constitutional Court that this law be declared unconstitutional.
The Kosovo Journalists' Association has forwarded the path of this law from 2021, and despite continued calls for the law to be drafted in line with constitutional and European standards, public authorities have not shown the will to respond to these calls.
This case is historic because it is the first time the Constitutional Court deals with the case involving media freedom, and the indictment will create precedents that will lead the court for decades. We hope our arguments will convince the Court to declare the constitutional law.
