According to DPSK, the trial of the preliminary procedure, Marjorie Masselot on July 8th 2024, confirmed the changes made by the Special Prosecutor's Office (ZPS) in the joint indictment, and ordered the SPS to hand over its latest version by July 10th, reports the “Bettim for Justice“.

According to them, once he surrenders, this indictment will be in effect in this court case. As a result, July 12 is scheduled for the first appearance of Januz and Bahtajri.

On July 8th, the court of preliminary procedure in the Januzi case, Bahitari and Haxhi Shala confirmed the changes to the joint indictment and ordered the SPS to hand over the latest version of this indictment by July 10th. After she surrenders, she will be an indictment in force in this court case. In line with Rule 90 (3), Judge Masseplot appointed the subsequent presentation of Januz and Bahtari on Friday, July 12th at 09:30”, the DPS report said.

Also, the revised version of the joint indictment against Haxhi Shala, Ismet Bahtiri and Sabit Yanuzi, by each means, has been made public, they are accused of obstructing justice management and obstructing official persons during the official office.

At a point in the SPS indictment, Bahtiri allegedly threatened witness 1 that in case he testified in Kosovo's Specialised Chambers, then he would kill him or his son.

According to the accuser act, between at least April 5th and 12th 2023, Shala, Januzi and Bahtiri in collaboration with each other and others have approached witness 1st. It is then said that the latter two, with Shala's instructions, have met individually with witness 1 to urge him to withdraw his testimony or not to testify in the TSK.

“This behaviour shows Shala's purpose, Januzi and Bahtirir to undermine and prevent an official person from performing official duties”, further said in the SPS indictment.

Then, reportedly on April 5th, Shala and Bahtiri called Januzi and after verifying that witness 1 was at home, Bahtiri went to his home, where he had asked him to withdraw the testimony.

“Bahitari told the Witness 1 that Shala had recently contacted and sent to tell the Witness 1 that he should withdraw his testimony. When Witness 1 asked whether he or his son would be killed if he testified, Bahhitari responded positively. He left the house of the Witness 1 and drove to a nearby car where two men were waiting, with a third person in the driver's seat. As a result of this approach, Witness 1 was concerned about his family's safety.”, said further in the SPS indictment.

Always in the act. ZPS highlights what the three accused later did after Bahtiri left witness house 1.

“Later on April 5, 2023, after Bahhitari's visit to Witness 1, Shala and Januzi, and separately Januzi and Bahtari, carried out many text messages and phone calls, including contacts between Shala and Januz to coordinate a personal meeting that evening. In the days that followed, Shala and Januzi, among others, remained in touch, including at least four times between April 6th and April 9, 2023”, the ZPS indictment said.

While the second contact with the witness had taken place on 12 April, when after a telephone call with Shala, Januzi had gone to the witness's house that he had demanded 200 thousand euros to withdraw the testimony.

At the Witness's home, Januzi told the Witness who Shala had asked Januz to attend Bahhiar's previous visit and find out what Witness 1 was planning to do and how the matter of his testimony could be resolved. Concretically, Januzi told the Witness who had asked Januzi to convey the message that if Witness 1 attracted his testimony, then Shala and other strangers would offer help. ) Witness 1 answered that if Shala and the others brought him 200,000 euros, there would be agreements. Witness 1 did not confirm or deny being a witness. Januz said that he would tell us what the Witness 1,<x0 was saying, adding that after his visit, Januz had called Shala.

According to ZPS, Shala, Januzi and Bahtiri are individually responsible at two points of indictment for obstructing official persons in performing official duties. The third point of the indictment, however, charges the three accused with criminal acts against administration of justice.

Otherwise, on February 8th, the trial judge, Nicolas Guillou, had approved the request of the Specialised Prosecutor's Office (ZPS) for joining the charges confirmed in the case against Ismet Bahtiriri and Sabit Yanuzi with Haxhi Shala.

In the decision to unify the charges, the pre-procedure judge has reportedly ruled that the two charges confirmed in the case of 10 and 11 charge the three accused for the same criminal acts, specifying that they have acted as a group. The ruling also states that the charges confirmed in these two cases are borne by the same actual claims.

According to this, the judge had decided that the SPS would grant permission to change the indictment confirmed in the case of 10, referring to the first amendment, while the second amendment was rejected.

Also, Judge Guillou instructed the SPS to file a request for a change in the indictment confirmed in the case of 10 according to the second amendment, but in line with the rules of Rule 86.

After the unification of the two charges was approved, Guillou decided that the common issue would continue with the KSC-BC-2023-10, which would be renamed in such a way as to involve the three indictees.

The Specialised Prosecutor's Office (ZPS) had handed over on January 12th 2024 the joint indictment on the case of Sabit Januzi and Ismet Bahtarir and Haxhi Shala.

At the first session, before the trial of the preliminary procedure, Nicolas Guillou, Bahtiri and Januzi have been declared innocent of charges imposed by the Special Prosecutor's Office.

According to the indictment filed on October 4, 2023, they are charged with trying to persuade a witness not to give a witness.

They are accused of attempted obstructing official persons for carrying out official office, by grave threat, between April 5th and 12th, 2023, criminal acts against public order, punishable under articles 17, 21, 28, 31, 33, 35 and 401 (1) and (5) KKP, and articles 15 (2) and 16 (3) of the Law.

Also, for trying to deter official persons from carrying out official office, through participation in a group's joint action, between at least 5 and 12 April 2023, criminal action against public order, punishable under articles 17, 21, 28, 33, 35, and 401 (2) and (5) KKP, and articles 15 (2) and 16 (3) of the Law. Also, for trying to intimidate during the criminal procedure, between at least 5 April 2023, criminal acts against justice administration and public administration, punishable according to provisions 17, 21, 31, 33, 35 and 387 of the KKP, and nines 15502) and 16 (3) of the Law.

On 6 October, in a report by the Specialised Prosecutor's Office, it has been said that Ismet Bahtiri and Sabitit Januzi have been arrested and transferred to The Hague under suspicion that they have tried to convince a witness not to give a witness.

According to the indictment, Sabit Januzi and Ismet Bahtiri, through the grave threat and joint action of a group of people in whom both attended, tried to prevent official persons, such as judges, prosecutors, court officials, prosecutorial officials or persons authorised by the court or prosecution, in carrying out official duties.

In the indictment of December 12, 2023, however, Chief Special Representative Kimberly West accuses Shala of fearing witnesses, trying hard to prevent official persons from performing official duties individually and group participation.
