Former police officials and others charged with corruption are declared guilty

Initially, the defender of the accused Blerim Pottera, lawyer Naim Rudari, has asked the court to call off the trial procedure, as according to him the investigation has had to be completed within two years, reports the “Justice Vow Vow”.

“The Code of Criminal Procedure of the Republic of Kosovo stipulates that when the investigation is under way, the same must be completed within two years, and unless, within two years, an indictment has been filed, or the investigation has not been eventually suspended, that action immediately ceases”, lawyer Rudari said.

According to him, Rudari has estimated that every minute from now on is a waste of time for the tribunal, prosecutors and lawyers, while for the accused it is a deepening violation of their rights and overcoming and dignity, once again seeking not to be prosecuted further in this trial, reports the “Bettim for Justice”.

This request by lawyer Rudari has been supported by all the defenders of the accused.

In this request by lawyer Rudari, prosecutor Zef Prendrecaj has considered that the lawyer's claims to pass the investigation deadline before the establishment of the indictment are groundless and at the same time demanded that the court continue with this initial session, while the defence request does not take into account.

For the nomination of lawyer Rudari and other defenders, the head of the court, Allton Murseli, has announced that the court will decide during the procedure of opposition to the dropping of the indictment.

On the other hand, at this session it is considered an indictment that charges the accused.

And in this session, the accused have been declared innocent: Visar Shala, Bedri Yanuzi and Januz Avdili, have not been declared guilty of the guilty Blerim Potter and Muhamet Balaj.

The Constitutional Prosecutor in Pristina on February 22nd 2024 had filed charges against two Visar Shala police officials and Bedri Januzi, as well as on Blerim Potter, Muhamet Balajt and Januz Avdili.

According to the indictment, defendant Visar Shala on May 10th 2020 in the quality of the official police person at the South Police Station in Pristina had deliberately misused the official task for the purpose of profiting for himself and the other person, overcoming his competencies.

The same, reportedly knowing that the traffic accident has not been caused, compiles false documents, the police report of May 10th 2020 in Veternik, the accident caused by Fetti Mulliqi vehicle driver “VW T4”, where Muhammad Balaj had suffered vehicle leader “BMW GX7”, property of Buying Potter from the company “Leasing Alberti sh.p.k”, also compiled the fake trafficking accident's anti-effection card.

These reports, defendant Shala reportedly signed them by setting up his ID number and placing his colleague B.A.'s initials with allowing Blerim Potter and Muhamet Balaj to benefit from the security company “Illyria” from presenting the sentence on the basis of a false document compiled in misuse of official office by the defendant.

With this, Shala is accused of committing criminal work “Use of official position or authority”.

On the other hand, according to the charge, defendants Blerim Pottera and Muhamet Balaj, following the preliminary agreement between them, with the aim of collecting money and insurance benefits from insurance companies, deliberately contribute to the false presentation of the accident to damage the vehicle.

This way, according to the indictment, defendant Blerim Pottera in advance as the owner of the <x0 vehicle with Leasing BMW GX7” and after accepting the false document compiled in misuse of official duty by defendant Visar Shala, the report on the traffic accident of May 10th 2020 in Veternik, caused by Feti Mulliqi, who was owner and driver of the “vehicle. VW T4”, with security police “Thellyria” introducing the vehicle driver “BMW GX7”, led by Muhamet Balaj, as being damaged.

It says the same on May 26, 2020, had submitted the application on behalf of Muhamet Balaj for compensation for the material damage of the vehicle “BMW GX7”, at the company “Ilillyria” after the false accident report was the Feti Mulliqi, which had secured the vehicle at “Illyria”, with their false submission of the two defendants placed in charge of “Illyria”, which compensates from 19 thousand and 540 euros of 16 euro, which they deposit to the <x>Cepeor <x> BMW GX7”, for which Brian Potter was compensated for in many of the 19 thousand and 467 euros from the company “Scardian”, for car damage in the case of self-accident of January 9, 2020.

With this, co-chaired indictees Potter and Balaj are accused of committing criminal work “Security Use”.

According to the indictment, defendants Shala and Januzi on December 9th 2019 in the quality of official police officials at the South Police Station in Pristina, in co-ordination and after the preliminary agreement have accepted money from Blerim Potter, where during the implementation of secret measures in audio-video recordings of December 9th, 2019, Visar Shala police officials and Bedri Januzi meeting with Blerim Potteri under the nickname <x0Tul<1>

According to the accusation, the money received by him is shared, defendant Shala acknowledges he has accepted 100 euros for the pro-March 17th 2020 report, and then another 300 euros for the security of the 10 May 2020 report, where they are seen in video-incizims, sharing the money with Bedri Yanuzin.

With this, Shala and Januzi are charged with committing criminal work “taking bribes” in co-ordination.

Afterwards, the indictment says the defendant Pottera on December 9th 2019 has directly offered bribes worth 400 euros to police officials Visar Shala and Bedri Januzi, for police officials to act in opposition to official office and for its benefit, while police official Visar Shala has compiled police reports on March 17th and May 10th 2020.

By that, defendant Potter is accused of committing criminal work “in bribery”.

On the other hand, defendant Bedri Januzi reportedly on May 10, 2020, with the aim of collecting money and insurance benefits allegedly for bodily injury, plans to meet with Jonuz Avdl and to insist on the accident.

According to the indictment, defendant Januzi while running the vehicle “Mercedes Benz” and associated with the passenger Gentiana Slovija under the precautionary agreement when defendant Januz led the “vehicle. VW Tour” prohibits vehicle with the aim of creating physical contact between two vehicles. It says that Januz is warning “axident” in the Kosovo Police, who go to the scene and the South Police station initiates the case of the accident with material injuries and bodily injuries to Gentiana Slovija passenger on the vehicle of the defendant Bedri, who provides medical documents in the name of Gentiana Slojina.

In addition, in the accusatory act, Slovia is said to be following the defendant's help and instructions, Januzi submits the request to the insurance company “Prisig” and as a result of the fake appearance of the accident-inskening accident, the insurance company connects the extratrial Watership of November 7th 2020 for compensation of the body damage of Gentinana Sllovoija and with the BKT mandate, the monetary means of many of 480 euros from the company <x26Pris> to the last resort of the country's<3>.

With that, defendant Januzi is accused of committing criminal work “Use of security”.

On the other hand, accused Januz Avdili was said to have helped defendant Bedri Jonuzi perform the criminal act of misuse of security by making his car “available. VW Tour” to install the accident planned by Bedri Jonuzi, knowing that defendant Jonuzi will stage traffic accidents when they meet on “Nekibe Kelmendi” street.

According to the indictment, the defendant Januzi had stopped while he was driving, the defendant Bedri approaches his vehicle “Mercedes Benz” and hits the back of the vehicle that Januzi was driving, where he allegedly caused bodily damage to the passengers Gentiana Slovia.

With this, defendant Avdili is accused of committing criminal work “Use of security”.
