Six months in prison on bail, 1 thousand euros in fines for those charged with bribery at the border

Those accused of bribery at Elez border point Hani, Bajram Krasniqi, Ahmet Abazi, Sabri Spahiu and Dardan Isaj were sentenced to two years in prison on bail and 4 thousand euros in fines (all), after the plea agreement reached between them and the Special Prosecutor of the Republic of Kosovo (PSRK) was approved.
The act in question was proclaimed by Judge Valbona Musliu-Selimaj on Tuesday, reports “The Justice Trust”.
According to this indictment, the four high-ranking indictees, each separately for the criminal act “Briganit” were sentenced to six months in prison on bail and for a thousand euros in fines.
According to Judge Musliu-Selimaj, the sentence pronounced in prison will not be executed unless the accused commits any other criminal acts within the verifiable period of two years.
However, the fined sentence of the same was imposed on them to pay in five months after this act becomes of formal form.
However, if fine sentences cannot be paid to the accused, this sentence will be replaced by prison terms, accounting for 20 euros for a day of imprisonment.
In addition, the accused were individually obliged to pay for both procedural spending and 50 euros for the judiciary and 100 euros for the compensation fund for crime victims.
Similarly, at the session held on the same day the court approved the plea agreement reached between P SRK and the accused with their defenders.
According to special prosecutor Naim Abazi, the plea agreement has been reached with free will and in the presence of defenders of the accused, as well as in accordance with the provisions of the Criminal Procedure Code.
So the prosecutor proposed to the court that the plea agreement with the recommended sentence be approved by the court.
The defenders of the accused, attorneys Faik Halili, Nededdin Sejdiu, Arifi, and Wisar Musa, who claimed the same was achieved with free will from their defenders and proposed that the tribunal be approved as such.
Otherwise, at the session, held on 21 May 2024, the court had phased out the criminal procedure for accused Ahmet Abazi, Sabri Spahiu, Bajram Krasniqi and Dardan Isaj, since the same had reached agreement on admitting guilt.
Other defendants in this case: Tomislav Dimiqi, Mensur Stagova, Vladan Ljubiq, Verodrag Miletic, Admir Sejdiu, Andrija Caviq, Mirko Yevtiq and Arben Aliu had been declared innocent of taking and bribery at Elez border point.
According to the indictment compiled on February 13th 2024, the seven customs officials: Tomislav Dimiqi, Mensur Stagova, Vladan Ljubiq, Verodrag Miletic, Admir Sejdiu, Andrija Caviq and Mirko Jevtic, as well as police official Arben Aliu, are being charged with “bribery”. While, Bajram Krasniqi, Ahmet Abazi, Sabri Spahiu and Dardan Isaj were charged with “bribery “”.
According to the indictment, Sabri Spahiu, Ahmet Abazi and Bajram Krasniqi were charged with criminal work “The bribe sentence” by Article 422, par.2 of the Penal Code. Also, accused Dardan Isaj was accused of committing criminal work “The possession of bribery” by Article 422, par.1 of the Criminal Code.
