Prime Minister Albin Kurti's new criticisms of special prosecution's failure to prosecute war crimes are being seen as continuing his intervention in justice. Recognisors say the prime minister should support the prosecution through budget and necessary legal changes.
Prime Minister Albin Kurti's criticism of the Special Prosecutor for poor performance is not rare during his term.
But the latter regarding the prosecutor's inefficiency in establishing lawsuits for lack of war crimes are being assessed as continuing the prime minister's intervention in justice.
Such statements are clearly interventions in the justice system, and this is determined according to the Constitution and is further relaxed on the part of the Venice Commission's opinions. What is up with the prime minister, in the concrete case, is to propose the necessary legislative changes that have been made and the second eventually to try to support him through the Law on the Special Prosecution of the Republic of Kosovo and here complete his mandate”, Gzim Shala, senior researcher at the Kosovo Institute for Justice (IKD), has said.
Although Shala estimates that the prosecution has not given any priority to prosecuting these crimes, he says any other statement by the prime minister outside these borders clearly shows interference in the State Prosecutor.
The assessment of Kurt's intervention in the prosecutorial system's affairs also agrees with lawyers.
For our opinion this is inappropriate and should not be repeated, or expressed by any power, much less by the executive power, which has a line of communication and dependence on the Ministry of Justice but also the financial aspect of the MF. In current situations, regardless of its importance to the legal system, law enforcement, but also the provision of citizens, there should be no statements considered to be intervention”, attorney Florim Shefqeti has been expressed.
P The SRK reacted a day earlier through a communique that such statements by the prime minister undermine citizens' trust and interfere with the institution's independence.
Kurti has often criticised the Prosecution during the first part of this year, mainly on anniversary of massacres committed by Serbs.
And the PSRK, Kurt had criticised him at the end of last year for failing to lift any charges of terrorist attacks on Banjska.
