In this case, Kosovo Special Prosecution has not yet filed an indictment
Therefore, no charges have been missed against the non-efficacy of this institution by Prime Minister Albin Kurti and other state leaders.
But, Flamur Kabashi from the Kosovo Institute for Justice shows that the prosecution in this case is in its legal terms.
“Special Procurory is within the legal deadline for drafting the indictment. There's only one prosecutor with all the information that's being taken into account and maybe he should be considered by the Special Prosecutor to help the prosecutor with another so that maybe it can be summed up as well and have an indictment available, but remember the prosecution is within its” terms, Kabashi said.
While he says such statements by power leaders are direct interventions in the justice system.
“The Government must understand that it does not improve the justice system through these statements, but rather makes interventions in the justice system through these statements by demanding accounts of why there is no indictment for this individual or this individual when we know that besides the parties in procedure that are authorised to take action for concrete cases all other parties have no authorisation and do not enjoy this right unless trial occurs before the republic1>, he says.
Anton Noecaj from the Clark Institute also stresses that such statements are unattended and should not be allowed.
Our <x0 institutions, including the prime minister and the president, support the whole process without any kind of pressure to support it in different forms based on the competencies the Constitution also provides for us to have a more powerful and more reliable justice system, and they must support reforms in the justice system”, Noeaj said.
Prime Minister Kurti has repeatedly accused the Prosecutor of delays even in investigating war crimes. /Tve1
