The government again violates the Constitution a law was promoted mostly by power

The Constitutional Court has declared the Law for the State Bureau for Influencing and Confiscating Unjustified Riches, which has been one of the main laws promoted by the Vetevendosje Movement, invalid.

In a decision announcement, the Constitution has said five articles of this law conflict with the Kosovo Constitution.

In the end, the Constitution has declared this law invalid in all. The decision has been made by five votes before and four against.

The law was sent for a constitutional assessment by deputies of the Democratic Party of Kosovo.

The law was adopted in February 2023 and has since been in Constitutional. The PDK, among other things, opposed the article regarding the Bureau's status.

The PDK had rejected the law as a whole, while Justice Minister Albulen Haxhiu had said sending the law to Constitution “aimed at dragging reform into justice”.

“1 of the European Convention on Human Rights; (ii) find out, with eight (8) votes per and one (1) a vote against, which measures 2.2 of Article 2 (Eviperation) in connection with Article 22 The controversial Law's (period of property verification) is not in agreement with Article 1 of Article 7 [Volves] of the Constitution; (iv) to state, (iv) by six (6) vote for and three votes against, that point 1.1 of Article 1 (Designing the Centiation Commission) of the Treaty, is not compatible with the 106 [resultability] of the Constitution; (v) found, by eight votes (1) against the 1st paragraph 1st, and the 1st Commission's texting, and the 1st C.6th C. [Rolley and the ombudsman Competations] and Article 134 paragraph 3 [Kyalification, Choice and Downloading of the Ombudsman] of the Constitution; and (wi) declared invalid, with five (5) votes per and four (4) votes against, in its entirety, Law No. 08/ L- 121 for the State Bureau for Influencing and Confiscating Unjustifiable Riches”, the report said.

We remember that the Law was adopted in early February, with support from the Democratic League.

The law envisioned the regulation of the way and procedures of verifying and confiscating property acquired unwarrantedly and the establishment, organisation and competencies of this bureau.
