All known for arresting two Kosovars suspected of spying on BIA Serb

A several-month investigative operation has resulted yesterday with the arrest of two suspected Serbian secret service agents in Ferizaj. Bedri Saban has been working as customsmen during the 1990s -- that is, during the Milosevic era -- while Muharrem Qerim has worked as Kosovo Police official until shortly after Kosovo's declaration of independence.

The early associate of the Serbian Secret Service (BIA) since the 1990s, according to these sources, was tasked with collecting information and making up for the purpose of staining Kosovo's image by building the same turmerism with Serbia and in the context of changing historical facts.

The detainees, according to the source, have been forwarded for years by security institutions.

Also, this source suggests that detainees have reported to a Serbian secret service officer named Srdjan Rosic.

Who is Srdjan Rosiff?

Srdan Rosic during the 1990s lived in Ferizaj while he was engaged as an officer in the Serbian secret service. His name has also been mentioned in the case of the trial against Serbian chief criminal Slobodan Milosevic at The Hague International War Crimes Tribunal.

In the transcript of one of the September 22nd 2005 court hearings, a witness who was a Serbian SUP officer (The Secretary of Internal Affairs), is asked if he knows Srdjan Rosicin. He answers that Srdjan Rosic at the time (V. The years of the '80s and '90s' was an operational employee at the State Security Service for the Ferizaj region.

But what have they done or tried to get away from Bedri Shaban and Muharrem Qerim?

Our information collected by Kosovo's security bodies says the goal has been contamination and criminalising KLAHA, through the study of evidence or manufacture of various witnesses.

Both Shaban and Qarim have evidence that contact with BIA's superiors has been kept physically and in other contacts.

Kosovo Customs Reaction

Kosovo customs has confirmed that one of today's spying detainees in Ferizaj, with initials B. S, he worked at this institution earlier, but that he had been fired from his position 20 years ago and that he has since had nothing to do with Dogan.

According to Dogana, his dismissal had come due to violations of the Kosovo Customs Goodwill Code, in terms of unauthorized communications with mass information tools.

“Since its dismissal, the person in question has had no connection with Kosovo Customs”, said the report.

Serbian BIA denies co-operation with suspects

Regarding the two arrests, BIA has been declared in a media communiqué denying “any co-operation relationship with the Agency”.

“The Agency for Security and Information( BIA) firmly denies all efforts to spread false news by the Albanian provisional institutions in Kosovo and Metohija, that two people with initials B. S. and M.Q., who were arrested today in Ferizaj on charges of committing the spying criminal act, have been in any co-operation relationship with Agency”, BIA's response reported.

But what does spying mean, and how does it work out in the Penal Code?

In the Criminal Code of the Republic of Kosovo, the criminal act of spying enters within the framework of criminal acts against the constitutional order and security of the Republic of Kosovo.

It ranks in Article 124 of this Code and implies some situations that include them; when the state secret is communicated, handed over, or made accessible to the foreign state, the foreign organization, or the person serving them.

According to this, minimum punishment is 5 years in prison, and the maximum is 12 years.

This article in his paragraphs envisions other situations and various punishments:

Whoever, for the state or foreign organisation, creates information in the Republic of Kosovo or heads such service, is sentenced to no less than 10 years in prison;

Whoever enters the foreign intelligence service, collects information about it, or in some other way helps work such service, is sentenced to no less than 5 years in prison;

Anyone who collects classified data or documents in order to communicate and hand over the foreign state, foreign organization, or the person serving them is sentenced to imprisonment of 3 to 10 years.

If such criminal acts are committed and cause serious consequences for the security or military or economic power of the state, the chief is sentenced to prison no less than 10 years.

However, if these criminal acts are committed during wartime, the inevitable risk of war, armed conflict, or the discovery of the state secret concerns the security of the Republic of Kosovo, the chief is sentenced to no less than 10 years in prison or to life imprisonment.

The state secret, according to the Penal Code, for the purposes of this chapter that deals with these works, implies the military, economic, or official records that have been declared as legally classified information or other provisions or decisions of the competent body released in accordance with the law.

Kosovo has the Law for Listing Information and verifying security whose purpose is “the foundation of a unique system for classification and storage of information related to the security interests of Kosovo, as well as for verifying the security of persons who have access to this information”.
