59 years in prison against 11 accused in case “Gropa”

The Constitutional Court in Ferizaj has declared a criminal conviction against 11 indictees in the case known as “Gropa”, condemning them to 59 years in prison (both).

Statement of the court was made Friday by the chairman of the court, Ilir Bytyqi, after hearings were held on June 25th for terminating the sentence, reports “Justice Vow”.

In this case, where about 67.5 kg of heroin and 25.5 kg of morphine and code were seized: Sahit Shaban, Afrem Derjan, Zafer Serkan, Valdrin Neziri, Besimi Hyseni, Faruk Diri, Avduvepa Diri, Murat Yilmaz, Halit Irez, Sylejman Yuruk, Mufail Shaban, Sefedin Derjan, Atif Shaban, Selman Shaban and Samir Hyseni.

On May 29, 2023, procedures for accused Atif Shabani, Samir Hyseni, Selman Shaban and Valdrin Neziri have been set aside, which, under the plea agreement that has been reached with the Constitutional Prosecutor at Ferizaj, were sentenced to 22 months in prison and 10 thousand and 900 euros in fines (both).

On Friday, however, the plea was pronounced against 11 other indictees, under which Sahit Shaban, Afrem Deryan, Zafer Serkan and Sylejman Yuruk were sentenced to 7 years in prison.

While accused Faruk Diri, Murat Yilmaz, Avdulvedha Diri and Halit Irez were sentenced to 5 years in prison.

Indictee Besim Hyseni was sentenced to four years in prison. Sefedin Dernan and Mufail Shaban, however, were sentenced to three years and six months in prison.

Judge Bytyqi indicated that in the prison sentence, the accused would also be counted as the time spent in custody.

According to the bias, the narcotic substances of the type of pure heroin 62.5 kg. and 25.5kg of crude heroin with morphine compounds and codes, as well as the tools for their production, distribution or transport, are permanently confiscated.

The accused have also been charged with the expenses of the procedure, so that for the judiciary (each separately) they are obliged to pay the amount of 100 euros on the deadline of 30 days after the indomitability of this act.

They are also obliged to pay the equivalent of 50 euros on behalf of the crime victims (each alone) in the term of 30 days after the indomitability of this act.

According to the indictment compiled on February 10th 2023 by Ferizaj's Founding Prosecutor, defendants Sahit Shabani, Africa Derjan, Zafer Serkan, Valdrin Neziri, Besim Hyseni, Faruk Diri, Avdulveha Diri, Murat Yilmaz, Halit Irez and Syleyman Yuruk, said that from April 23rd 2022, without authorization at the home of the defendant Hyseni in the village of Firjaj, the Shrpca municipality and at the Mofail Bay on Mufail <0> Success”, in the village of Varos, Ferizaj's municipality, has produced heroin - type narcotic substances and 62.5 pounds [67.5 kg], while 25 pounds [25 kg] had failed to produce it.

According to the indictment, defendants Sahit Shaban, Afrim Deranyan, Valdrin Neziri and Zafer Serkan had organised the transport of the first narcotic substance, which they had brought from Iran through Turkey-Greece and Northern Macedonia, which they had placed at a warehouse on “Astrit Bytyqi<1>, then had improvised a heroin production lab in the home of the defendant Hyseni village of Firaj, and had begun providing tools, which the defendant of the Avfilpillus.

The attack, according to the indictment, had come to Kosovo on May 7, 2022, the defendant Zafer Serkan, who during his five-day stay, in addition to the daily encounters with the defendants Sahit, Africa and Avdulvep, in order to prepare the best conditions for heroin production, on May 8, 2022, and with Sahit, also met with the person named Valon Sylqa, who had provided five bidos, each weighing 50 liters, and 8 bidos, each with 10 liters of liquid juice, after two days' production of vehicles, and two vehicles, sent to the village of Derfjaj, which were sent to the village.

On May 13, 2022, according to the indictment act, the defendant Faruk Diri had arrived in Kosovo, while on May 15th 2022, defendants Halit Irez and Murat Yilmaz had come to Kosovo, and on May 18, 2022, the heroin production process had begun, but on May 20, 2022, after the same had suspected that the police had put them on the trail, defendants Afrem, Besiman, Valdrin, from Fira, who had pulled the narcotic to that time and the rest of the village of Mufail.

It is further said that, after defendants Zafer Serkan and Sylejman Yuruk, who had met with defendants Sahit, Africa and Avduve, the latter after this meeting, then along with Faruk Diri and Murat Yilmaz had resumed producing heroin.

And on May 23, 2022, according to the indictment, police had raided the defendant's home of Mufail Shaban, where the amount of 67.71 kilograms of heroin narcotics was found, while on August 30th, 2022, an uninhabited home in the village of Doganaj had also been found a total of some 255 kilograms [25 kg] of crude narcotics, with morphine compounds and codes.

In this case, those overarching were charged with performing criminal work “production and unauthorized processing of narcotics, psychotrope, analog or tools, equipment or narcotics materials” by Article 268, par. One and two. Four with Article 275, par. One, below. 1.1 and 1.9 Penal Code.

According to the indictment of the defendant Sefedin Deranyan, deliberately and aware of the criminal activity that had been carried out since April 27, 2022, he had offered logistical assistance in the heroin-making process, making sure to find the warehouse where the sacks were first placed in which they were located even the first basic subject of heroin had contracted people to empty tea bags, in which they had been located the heroin base content, as well as the defendant Afrim Deryan at the Skopje Airport had taken the defendant from Abdililil Dirill, who had been hired by the automogentine Anfian, who had been used by Derfry.

They were also said to have contracted witness Agron Berisha, with whom, along with defendant Africa Dernan and the person named Samet Derjan, in Pec, had obtained the tickets filled with touchy for narcotics production.

In this case, defendant Deranyan was charged with performing criminal work “assisting in carrying out criminal acts, production and unauthorized processing of narcotics, psychotrope, analogue or tools, narcotics equipment or materials” by Article 268, par. One and two. Four with Article 275, par. One, below. 1.1 and 1.9 of KPRK.

Always according to the indictment, defendant Mufail Shabani, from May 20th to May 23, 2022, on the “road. Success”, in the village of Varos, deliberately and thoroughly aware of the activity to be carried out, had rented the second floor of his home, defendants Sahit Shaban, which was exploited as a heroin - producing laboratory in which the home had become the final processing of narcotics, in which defendants Abdilvep Diri, Murat Yilmaz and Faruk Diri had been found and seized the amount of narcotics of 67.5 pounds [67 kg] of heroin.

He was accused of committing criminal work “, assisting in carrying out criminal work production and unauthorized processing of narcotics, psychotrope, analog or tools, narcotics or narcotics materials” by Article 268, par. One and two. Four with Article 275, par. One, below. 1.1 and 1.9 of KPRK.

The charge, said in the indictment, was that defendant Atif Shabani on May 22, 2022, after defendants Sahit Shaban and Africa Dernan had been taken out of the car <x0pe Astra” two sacks that were taken to the village of Firaj, with the intention of preventing or hiding the evidence, originally about 10:44, had received two white bags that had been placed in a cart, then sent to the defendant Mufail Shaban's house, and a large gas tank.

With that, he was accused of committing criminal work “Peging evidence in the official procedure”, from Article 386 pars 2 of KPRK.

While defendant Selman Shaban was charged on May 22, 2022, in the evening, at the request of defendant Sahit Shaban, with the intent of preventing or hiding evidence, he went home and from his second floor, his father Mufail Shaban, where he had been producing narcotics, Turkish citizens who had received three sacks, placed them in the chariot, and sent them back to Sahit Shabani.

With that, he was accused of committing criminal work “Peging evidence in the official procedure”, from Article 386 pars 2 of KPRK.

The defendant Samir Hyseni, on the other hand, was charged that in order to hide evidence in the court procedure, on May 20, 2022, he had gone to his home in the village of Firaj and, with the aim of preventing or hiding evidence, had begun to clear the country, where Turkish citizens have stayed, as well as to remove and burn some of the items that were used to producing narcotics.

In this case, defendant Hyseni was accused of committing criminal work “Peging evidence in the official procedure”, by Article 386, paragraph 2 of the KPRK.
