Four sheepers accused of enrolling students in the UPP are silently protected

The four accused of counterfeiting documents about student registration at Pristina University “Hasan Pristina”, Mimoza Beqiri, Behare Bajrami, Betim Ismajli and Ardian Hamiti at Friday's session at the Pristina Foundation Court are protected in silence.

The four indictees are being charged with counterfeiting documents, while defendant Bajrami is also being charged with “due to use of official task”, reports “Justice Vowif”.

Clearly, the trial in this case was initiated recently due to the changing court member, so that instead of the judge now sponsored Agim Kuci, a member of this body, Judge Ertan Seylula.

After the trial began recently and the indictment was considered read and read, the four accused have been found innocent of criminal acts being charged.

Also, prosecutor Halim Borovci and the defenders of the accused remained in general close to the earlier opening word given in this court, as well as were considered read statements of all witnesses heard in the trial.

Later, the trial continued with the management of material evidence, where as material evidence procured Borovci has mentioned several confirmations and set-up of the semester, which according to him confirms the criminal act that incriminates the accused according to the 1st indictment, that is, in the direction of criminal offense “Falsification of document”

“Because these documents are presented as being issued by the Central Administration of the University of Pristina, which this authority itself has confirmed is not author of these documents and on the grounds that even the registration of these candidates for UPC students” has not been accepted, prosecutor Borovci said.

Also, as material evidence prosecutor Halimi has mentioned textes exchanged between indictees and other parties during the 2013-2014 period.

These tests, defender of the accused Beqiri, lawyer Shefqet Hasimi has called them unacceptable in terms of the professional power of the test.

According to him, these evidence does not present adequate evidence which testifies to the counterfeiting of documents. The defender of the accused Bajrami, lawyer Leotrim Himaj, declared the same.

Himaj said that the Sms endorsed by the prosecutor are evidence that only criminal acts in relation to them have been prewritten.

So we have several textes that were read in 2013 and the beginning of 2014, which in relation to the actual criminal record of the indictment, these evidence have only aged”, said lawyer Himaj.

Notes about these evidence also contained defenders of the defendant Ismajli, lawyer Naser Soopyan, who said that retroactive sms issued under the 2012 ordinance are all illegal evidence, drawn against the unconstitutional law.

Because it is known that the Penal Procedure Code provisions have clearly regulated that all orders have an extended deadline and all of these are worth the launch date, no legal provision of the Penal Procedure Code doesn't predict that orders have a retroactive effect, and that is why orders are issued by”, Soopyan said.

Such a statement, Sopijan said it was given by the Constitutional Court, which has found that in such cases the removal of sms in a retroactive way is a violation of Article 36 “

As to claims allegedly falsified by the prosecution, attorney Soopyan said that there is no stand for this claim because there is no proper examination to ascertain whether they are forged or not.

And then, on the prosecution's side, forged documents were introduced without any examination by field expert”, Soopyan said.

According to him, all documents listed in the indictment as material evidence are documents relating to the period before November 20, 2013, which, according to him, even if they're forged, have to do with documents that, under the criminal offense, have gone double the prosecution.

Even the defender of accused Hamiti, lawyer Mentor Bogay, had remarks on the evidence. He said the messages listed by the Prosecutor are not evidence proving the criminal record “Falsification of document”

Bogaj said there is no material evidence confirmed with the relevant expertise with which the commission of criminal work, which would be proven to be a burden on his defense.

The court also approved as material evidence the work contract regarding accused Bajrami, which was proposed by her lawyer Himaj.

At the next session, the final word is expected from the parties in the procedure.

Mimoza Beqiri and Behare Bajrami were charged with joining Ermal Durak, Anton Yakaj, Daut Ademiaj, Ilir Mqirat, Raymond Osman and Edona Saum had committed criminal acts “Deception” by Article 335, paragraph 1 related to Article 31 of KPRK and “False announcement” from Article 390, paragraph 1 of KPRK, but for these criminal acts, it has reached the absolute prescription of prosecution.

Otherwise, Pristina's Constitutional Prosecutor has filed an indictment on 31 May 2017, against Mimoza Beqiri, Behare Bajrami, Behim Ismaili, Ardian Hamiti, Ermal Durakut, Anton Jakaj, Daut Ademi, Ilir Murat, Raymonda Osman and Edona Sas God, with the reasoning that by 2013-2014, with the aim of counterlawing, they have forged various documents.
