One of three power-related judges is appointed to Telekom-Dardafon case

Advanced by power, Franciska Julitia, a judge of the second-instance Chamber of the Commercial Court, will decide on the Telekom-Dardaphone issue in which the interested party is the Government of Kosovo.
Jutilia has been appointed leader of a Comercial Appeals Court, which will decide in the case of Telekom-Dardafon, has learned Paparaci from sources close to the Commercial Court.
The court's appointment at the Commercial Court in May 2022, Franciska Gitia, is part of the court's second instance. He has participated in taking some decisions where the interested party is power.
With the Justice Ministry's proposal in October last year, Dzitia, along with two other judges of the Commercial Court, Faton Bajrami and Saranda Gogaj, had been appointed to the Commission for Providing the Jurisprudence Test. All three are involved in judging the materials where the party was power: the case “A” and the Telekom-Dardaphone case.

Proposed by the government in October, in mid-December 2023 they were voted in those positions by MPs from the parliamentary majority.
In January of this year, Franciska Dzitia was reported to be the daughter of Hilmi Dzizi, a convicted prosecutor for the alleged political persecution of Kosovo Albanians in the former Yugoslavia era.
The name of Hilmi Dzizi and 29 former communist system operatives were part of a criminal confession deposited by Nat Hasani, the former Kosovo Assembly President. Based on Hasan's criminal impeachment, Gittia and others suspected “of crimes against humanity and genocide”.
Justice Hilmi Dzitia has described the former system's criminalised image list as absurd. In a statement to the World Today in 2010, he said he was one of the first Albanian detainees from Serbian institutions in early 1990.
By February 18th, 2022, the final decision has been made in the Telekom-Dardaphone case in the International Referee.
In March of that year, the proposal for recognition and execution of the foreign arbitration decision has been put forward. Contrary to that request, Kosovo Telecom presents the indictment for canceling Arbitrazhi's decision.
In September, the Commercial Court took the ruling with which the combination of subjects takes place, as a proposal for recognising the foreign arbitration decision and the indictment for canceling the arbitrage decision.
On February 20th of this year, the act of September 8, 2022, with which the subjects had joined, had now been processed separate courses under the proposal for recognition, and the indictment for annulment of the arbitrage decision. The proposal for recognising the foreign arbitration decision has remained to be prosecuted at Judge Arber Rexha.
On March 27th of this year, the Commercial Court issued a ruling with which it was declared uncontinent in its official view regarding the object of the dispute under Telekom's indictment for canceling the arbitration decision and dismissed the indictment as incorrect.
Kosovo's telecom had filed complaints with the date 04.04.2024, against the decision to impose non-competitive statements and to dismiss the indictment as illegal, and now the subject is found in the Second Stair Rooms of the Commercial Court.
