Murder in Dujaca of Gjakova, defence proposals for two experts and exits in the conference rejected

The accused Knushi, in this case, is being charged with killing M.J., following a dispute to remove the power cable from the house, reports the “Justice Trust”.

Initially the defender of the accused Knushi, attorney Bash Dodaj, had proposed that the court and other parties in the procedure be taken to the scene, as well as the sending of the accused Knushi to psychiatric examination, prove his mental state when he met with the victim until the time of shooting.

Regarding these proposals prosecutor Ardity Beciray, in writing and in the hearing, has stated that as regards the first proposal for exits to the hearing, she gave the court an assessment, while the proposal for psychiatric examination of the accused countered by saying there is no material evidence proving there is and there was some psychiatric problem.

“Defence Determination Determination for the fact that the same has had mental shock or concern, fear of the eventual attack, this fact or this circumstance we have not been able to prove either during the investigation or given the screening phase where we are now, no evidence has been proven that the defendant was or exposed to such a situation, and on this basis we have proposed to the second proposal court to be refused”, prosecutor Beqiray said.

Also, the owner's representative, lawyer Korab Bocshi, has rejected the defendant's proposals, arguing that there is a report on the site's viewing, while in terms of the second proposal, said it is an extra attempt to avoid criminal responsibility.

On the other hand, the defender of the accused Knushi, lawyer Ndek Dodaj, had another proposal, that two acts of forensics be sent for a super-expertity, to consider other experts about the real cause of the now deceased M.J.'s death.

Protector Dodaj, with his proposal for the ostentation soup, clarified the circumstances that death would now come from the infection following the second operation, or the now deceased's carelessness.

According to him, the first time the deceased was in a regular, stable state of life.

That proposal was rejected by prosecutor Beqiraj, as well as the representative of the damaged party, Bokshi.

Later, Judge Sami Shardaku's court panel, led by Judge Sami Shardaku, made a decision to reject the proposals of defendant Knushi, lawyer Dodaj, arguing that the defence stand had not provided sufficient reasons.

While rejecting psychiatric examination, Judge Shardaku said there is no evidence that the same in the past has suffered from any mental illness, as well as refusal to super-expertise, the judge said there are two forensic experts on the subject.

The session was then interrupted to continue for another date with reading the evidence as well as protecting the accused, since he was unable today to provide his defense.

Otherwise, according to the indictment filed by Gjakova's Constitutional Prosecutor, the defendant Speed Knushi is charged that on July 4, 2022, about 21:20, in the village of Dujaca Gjakova, he has deliberately deprived the late M.J. of life now.

According to the indictment, the cause was a dispute over the removal of an electric cable from the victim at the defendant's residence in the mountains.

After an argument between him at one point, the defendant had pulled his pistol out of his belt and, at a distance of 2-3 meters, shot first onto the ground near the victim's feet and then shot him into vital parts of the body.

For these he is charged with the criminal act of “murder”, by Article 172 KPRK's, as well as the second “arms ownership or unauthorized possession”, from Article 366 par.1 of KPRK.
