New material evidence in corruption trial against former members of Mitrovica Hospital Steering Council

In this case, Mirdi Strana, Ixmet Rexhepi, Zahir Musa, Beating Merovci and Fatime Zeneli, where the first defendant as chairman and others as members of the General Hospital Steering Council in Mitrovica, is being accused of advancing an employee to this hospital, ignoring legal procedures.

Initially, the chairman of the Beqman Beqiri panel announced that the defender of accused Mirdi Strana, lawyer Armend Shkoza, has submitted a proposal that the witness's quality the legal officer at Mitrovica Hospital, Freedom Bayraktari, should be invited.

The judge also said Shkoza has proposed to ensure the decision of the Steering Council to establish the position of an employee and the decision to accept two doctors at work.

The defender of the accused Strana, lawyer Armend Shkoza, said they remain on the whole close to the proposals.

On the other hand, defendant Ixmet Rexhepi's defender, lawyer Faruk Korenica, proposed that witness-quality the representative of the hospital, whose name he said he did not know, be invited. He proposed that this witness be heard with the reasoning that from the financial expertise report, the damage is 37 thousand and 448 euros and 26 cents.

On the other hand, prosecutor Fetije Bajrami said that since all material evidence on the subject has been administered and new evidence has now been proposed, it allows the court to assess it on official duty.

Even the defender of the accused Fatime Zenel, lawyer Faik Jashari, said the proposals made let the court assess.

While the defender of the accused Zahir Musa, lawyer Isa Hyseni, rejected lawyer Shkoza's proposals. In presenting objections to these proposals, lawyer Shkoza called on what the court pronounced to this latter.

Similarly, the defender of the accused, Merovci, lawyer Drita Shabani, said they generally oppose proposals to issue new evidence.

Later, the court approved the defendant's proposal Strana's defense, lawyer Shkoza for the official legal hearing of the witness quality hospital.

While, proposals were rejected for ensuring the hospital's Steering Council's decisions on establishing an employee's position and decisions on hiring two doctors, arguing that these decisions have nothing to do with concrete cases.

Similarly, the Court rejected the defense proposal of indictee Rexhepi, lawyer Faruk Korenica for hearing the hospital's representative regarding the damage filed by financial expertise, arguing that the court has already ruled on the issue, since it has not been proposed in the indictment as a damaged party in Mitrovica Hospital.

The next session is due to be held in June.

The Constitutional Prosecutor in Mitrovica on June 16th 2022 has filed charges against Mirna, Ixmet Rexhepi, Zahir Musa, Beating Merovci and Fatime Zenel, with the reasoning that as official persons, Strana leadership, Rexhepi, Musa, Merovci and Zeneli as members of the General Hospital's Steering Council in Mitrovica, using official office, have exceeded legal competencies with the aim of profiting for themselves or another person or harming the other person.

According to the indictment, the same on purpose, without ignoring the competition procedures after it had to be announced, at the meeting held of the Steering Council on June 30th 2015, have approved Arbnor Bayraktari's application with education “Bachelor of the arts at the management”, for advancement in the post “intelligence manager (TI) ”4> with cofient 8.40 (base 634 euro and 39 euro), though Baytar has had an indefinite work contract in the February, the 13x-dector <5> at the Serbian Health Hospital, 296HareCHarearearea, 2980 euro base).

The indictment says that defendant Mirdi Strana, contrary to the No.03L212 Labour Law, has ruled on June 30th 2015, along with other defendants, under whom Arbnor Bajraktari appointed “Information Technology Manager (TI)”, the Department of Administration and Assistance Services at the General Hospital in Mitrovica, with what have caused financial damage to the health ministry's budget until the establishment of criminal wire value of 14 thousand and 482 euros.

With this, they are charged with having committed criminal work “The use of official position or authority” by Article 422, par. 1 connected to Article 31 of Penal Code. /Betimy for Justice
