Many are the tender points worth about 11m and a half euros for uniforms in the Kosovo Police, for which experts from the Procuration Organisation have concluded they are contrary to the Procure Law.
The 28-page expertise also summarizes the claims of a company related to the elimination of the race, but also the reasons why the winning consortium should not win the tender.
Out of 17 claims as a whole, experts have found that 14 Sosh are partially or fully based.
At one point, expertise finds that demand for laboratory tests regarding the quality of uniforms has not been made in line with the Public Procurement Law. Among the findings is that Kosovo police have changed one of the criteria to the electronic system.
The “Experts have explained even earlier that, according to them, it is not acceptable that for samples required according to pre-technical specifications, among other things, including length, width, height, weight, washing stability, washing temperature. etc., specifyings to be determined in 2023 through contract reporting and for the same samples, laboratory tests to be carried out in 2021”, OSHP expert says.
According to expertise, police deviations have also had the specifics required for each product.
“In the concrete case it becomes very problematic to know where the limit of how far this deviation might go, because we consider that the deviation after deviation should not be allowed and not in many cases as it has been in the case of the recommended operator”, says the expert.
The expert says the demand in the tender file has been very unclear and that the criteria that limit competition should not be allowed.
Claims of fraud and counterfeiting in this millions' tender have also been filed.
But experts have said they are not competent to address such claims.
“About the claim filed that the AK's non-communication of communications with the labs and the certificate bodies is the fact that several recommended OE certificates have resulted in false and in incorrect data, and for this point the expert explains that it is not professionally called to prove the counterfeiting of these documents, so these requirements should be directed to competent”, it is said in expertise.
Because many violations have been found, experts have proposed cancellation of the tender.
“Taking into account the created situation, where appropriate assessments are difficult on the basis of existing criteria and the performance of this project described above, experts estimate that this procurement activity at this point should be annulled”, says expertise.
