On exit from the JKKO, Berisha's lawyer Genc Gjokutaj again attacked the Special Prosecutor, saying he is acting as a political party.
Berisha is officially under house arrest where the Court against Corruption and Organised Crime has ruled, following request from the SPAK Special Prosecutor.
On December 21st, it was Albania's Assembly, which opened the way for Berisha to be arrested by SPAK.
Despite voting only with majority votes, Berisha has rejected this parliamentary decision against him and could therefore deny all circumstances of house arrest.
But what specifically does the Berisha issue have to do with?
The Special Anti-Corruption and Organised Crime Prosecutor Tirana (SPAK) would reveal through an official announcement investigative details concerning the privatisation of the former partisan club complex.
Among the accused were former Prime Minister Sali Berisha with his concrete actions to make his son-in-law Jamarber Malltez benefit from this irregular scheme.
Rather, the investigation object of this criminal prosecution, according to the SPAK, was the action carried out by top state officials and others, for the privatisation of the “Party Football Club” and <x2Klubit Partizani” terrain and sports facilities.
The Special Prosecutor doubts Berisha has consumed the passive criminal work of corruption of senior state officials or local elected, carried out in co-operation with citizen Jamarber Malltezi, envisioned by Article 260 and 25 of the Penal Code.
The SPAK adds that Berisha in his quality as prime minister of the Republic of Albania, allegedly committed concrete and active actions, in adopting laws or illegal acts.
This, in order to adapt them according to the needs presented to five prominent property families, where the direct winner among others, resulted in Jamarber Malltez.
Berisha, allegedly even committed active actions to carry out administrative controls, with the aim of exercising pressure and providing concrete orders for the conclusion of privatisation procedures, in favour of Yamber Malltes, follows the SPAK.
According to the prosecution, Berisha allegedly also committed active actions in the provision of the various structures of the state administration for realising the process of privatising state property.
