Germans don't change their attitude after Gervales' letter: Drift-statu São has been sent to Constitutional Court

A day before the Committee of Ministers meets in Strasbourg, the Kosovo Government this morning has sent a letter to the president of the Parliamentary Assembly of the Council of Europe on pledge that it will prepare a draft for the establishment of association and which it will deliver to the Constitution by the end of May. The German Embassy in Kosovo in a response to Gazeta Express has said the recent Kosovo Government movement makes the major step required by Kosovo.

“Quint and others have consistently stressed that Kosovo is expected to take tangible steps to establish association (ASM) in order to achieve the necessary two-thirds majority in the Committee of Ministers for application for membership to be successful. In our opinion, handing over the draft status to the Constitutional Court before the Committee meeting would be such a step. As Ambassador Rohde said in his tweet post following the vote at the Parliamentary Assembly of the Council of Europe: “Kosovo must now do its hard work”. That still hasn't happened”, German Embassy spokesman Christian Bötcher said.

Germany and France have asked Kosovo to take urgent and concrete steps towards establishing the Association in exchange for receiving their support for Kosovo's final vote for membership in the Council of Europe.

Prime Minister Albin Kurti has rejected this request, prompting Kosovo not to join the Committee of Ministers agenda on May 17th.

However, the possibility is that the agenda will change in the last few minutes.

For this, the day before the meeting in Strasbourg, Chief Diplomat Donika Grovall announced of the decision made on the pledge that the draft Association will be submitted to the Constitutional Court by the end of May.

“Within the process of membership in the Council of Europe, following the 82 % vote of the Parliamentary Assembly of the Council of Europe in favour of this membership, within the pledges made by the three heads of state, this morning I have sent a letter to the president of the Parliamentary Assembly of the Council of Europe. The letter contains the pledge that the government of the Republic of Kosovo will prepare a draft for the establishment of a mechanism for isolation, co-ordination and co-operation of Serb majority municipalities in Kosovo, which meets Kosovo's inherited international obligations, meets the needs of the citizens of the Serb community of the Republic of Kosovo, but also respects the Constitution and in each detail all the laws of the Republic of Kosovo, as well as the principles of the Council of Europe. Such a draft serves on one side the government's intention to integrate non-US communities and implement the laws of the Republic of Kosovo in all municipalities”, she said.

She said the draft provides not only the full respect of the Constitution and laws of the Republic of Kosovo, but at the same time unable to make illegal interventions from abroad, both in Kosovo municipalities and throughout the country.

“After today's realisation of our pledge to take an important and tangible step in fulfilling our commitments, we seek and expect the Council of Europe to fulfil its share of the obligation and invite Kosovo to join the Council of Europe without delay, as the country not only which has been placed mostly conditions for membership in this organisation but which has met all these conditions. Independent and sovereign Kosovo, as a legal and democratic state, remains on its steadfast course towards NATO and EU membership”.
