Retrial back: 35 years in prison for man who killed woman with ax in Pristina

The Act on Goden was proclaimed on Wednesday by Judge Naser Foniqi, reports “The Justice Act“.

This indictment was pronounced in the absence of the accused, even though police officials said the accuser was located in Pallat.

In prison sentences, the same will be counted as spent time in detention. Goden remains in custody until the power of the decision.

Otherwise, the Constitutional Court in Pristina had sentenced Goden to 25 years in prison because of his serious criminal offence.

But, the Court of Appeals on September 26th 2023 had turned the case into a retrial on the grounds that the Constitutional Court's decision in Pristina is involved in substantial violations of the Criminal Code of the Republic of Kosovo.

Consistently, Apel's decision states that the defender of the accused Goden, lawyer Myrvete Hasahni, has not been of reconciliation for admitting the criminal act by the accused and that her client has not been sufficiently consulted in terms of admitting guilt. Thus, according to Appeals the guilty plea from the accused Goden is done outside legal norms and not based on all the facts and cases of the indictment.

According to the indictment, it is said that on November 25, 2022 about 4: 00 p.m., Izet Goden had brutally deprived his wife S.G. of life.

So, with these actions, Izet Goden was charged with criminal work “grave murder” by Article 173 paragraph 1 points 1.3 and 1.4 of the Criminal Code of the Republic of Kosovo.
