We're talking about membership in KiE: Ignoring request for implementation of Constitutional decision on Decani Monastery returned

Kosovo institutions continue to resist international demand for implementation of the Constitutional Court's decision on land at the Decani Monastery, on the banks of the Lumbardh River, two kilometers from the city centre.

Chief EULEX, the European Union's mission of rule of law, Giovanni Barbano yesterday, called for implementation of the Constitutional decision for the Decani Monastery.

“Questioning the Constitutional Court and judicial decisions undermines the independence of the judiciary, eroding the rule of law. 2016's decision to the Decani Monastery is binding on all persons and institutions, except for”, he wrote in “X”.

His post was distributed by Germany's ambassador to Kosovo, Jorn Rohde, has demanded that the Kosovo Government implement the Constitutional Court's decision on the Decani Monastery.

A day earlier Tuesday, the German ambassador took seven deputies to the Decani Monastery. Serbian cleric Sava Janjic thanked “for the discussion and hospitality”.

Last month, Rohde said Kosovo would not see itself in the Council of Europe unless it implements the Constitutional Court's decision on the Decani Monastery.

No Kosovo government has implemented this decision. Sometimes it takes time to do the right thing, but I don't see Kosovo's candidacy for membership in the Council of Europe succeed if this issue is not resolved. Soon there will be a discussion about it, and recommendations will be made on what must be done before the accession vote, and this issue will be among those recommendations”, he said in an interview for “Kosovo Online”.

Several days after that statement, President Vjosa Osmani had a meeting with German Ambassador Jorn Rohde, where she had talked about the Kosovo membership issue at the Council of Europe.

“In this direction, President Osmani and Ambassador Rohde talked about Kosovo's membership in the Council of Europe, with President Osmani establishing particular importance for this process to be successfully completed”, it was said at the Presidency's announcement.

The government officials' meetings with the delegation of the Parliamentary Assembly of the Council of Europe have been concluded without details for the report KE has released for Kosovo. In that report, in addition to interventions in the judiciary, the executive had also been mentioned in the court's unmet decisions.

The KiE experts, in the first report, had also cited the implementation of the bias that recognises ownership of the Decani Monastery on that land and the founding of the Serb majority municipalities' association.

Institutions have shown no indication that they will allow the Decani Monastery to register 24 hectares of land and forest in the cadastre, since they say it was taken from social companies, the honey factory “Apico” and hotel “iliria”.

Prime Minister Albin Kurti says the Constitutional Court's decision is based on Serbia's discrimination policy from the 1990s, ignoring continued EU and US requirements to implement it.

From 2000 to 2016, he had extended the judicial process for that land until the Constitution decided in favor of the monastery.
