In its statements, the SPS has stressed that in the latest modification to the detention conditions, the panel has correctly ascertained those measures were necessary and proportional to Krasniqi's rights and that it does not make continued detention unreasonable.
“Linked to the recent modification of detention conditions as a preliminary issue, the panel has correctly singled out the immediate issue as a matter of detention or provisional release, not detention conditions, and the first falls under rule 57 and the second by rule. 56k.6. In any case, the panel has already found that none of the circumstances identified by Krasniqi over the restrictions imposed on other indictees would have a material impact on considerations involving his detention. The panel has further found that those measures are necessary and proportional and compatible with Krasniqi's rights and that they do not make it unreasonable to continue detention”, the SPS response reported.
As a result of these cited reasonings, Z. The SP has suggested that the court should continue detention for Krasniqi.
