Miftaraj for Kurti government: Institution Intervention Champions

Miftaraj for Kurti government: Institution Intervention Champions

Kosovo Democratic Institute of Kosovo Director Ehat Miftaraj has balanced the balance between the successes and failures of Kurti Government in justice. All of this after Kurt went on Facebook for justice in his three years of government, where he only counted successes, always according to him. Miftaraj, although he recognizes some success, such as political will [...]

Miftaraj, though familiar with some success, such as the political will for self - sacrifice, has also listed a series of failures in this government damster.

“Intervention champion at independent institutions”, of “aming of its officials”, are some of the Miftaw criticisms of justice in the Kurti government.

Yeah. TYPE:

Government successes and failures Kurti in justice summed up in three years:

Success:

  1. Vetting, the merits belong to the government for political will to carry out this vital process of rule of law. Even though Vetting is going to be half and even though the Constitutional Amanda has not yet been adopted in the Kosovo Assembly, it can still be considered a success of this government.
  2. Founding and functioning of the Commercial Court. This cannot be considered the success of Kurti's government, since the law on court is a law that is initiated by the past government, political established with the Strategy for Rule of Law. The functioning of the Commercial Court is the complete success of the Kosovo Judiciary Council and USAID. KCK and USAID have led with this process, which they have successfully finalised. The government has not shared the budget needed for the proper functioning of this court. Add commitment, don't budget, create new problems.
  3. Adoption of laws for the Agency for Prevention of Corruption and for the Declaration of Riches is the success of this government. However, the government has allocated enough budgets for the Agency to prevent corruption, taking additional competencies defined by law to base. Add commitment, don't budget, create new problems.
  4. Important laws such as the Code of Criminal Procedure and other laws have been adopted.

Failures:

  1. Reforming the criminal, civil and administrative justice system.

Three years wasted. After three years of reform in the prosecutorial system is in the ZERO phase. The KKP bill is in the Assembly. The same bill is considered by the Venice Commission and the Constitutional Court for violating the principles of rule of law. Let us hope that at least during 2024 this law will be adopted and enacted. With the law's entry into force, the composition of the KKP will change in after two or three years. So, the KPK reform will not succeed in the mandate of this government.

The Law for the State Bureau for Confiscating Unjustified Riches is in the Constitutional Court. The first bill of this Law was considered in its entirety by the Venice Commission as a law against standards that guarantee and promote human rights and freedoms.

Civil Justice:

For approval of the Civil Code, there is no political will from the ruling party for the same vote. Civil code is considered the most important law on citizens' rights immediately after the Constitution.

Administration Justice:

Reform in administrative justice is too late. The bill was adopted in the government. It has taken three years for the draft law to be drafted and approved in the government.

The electoral promise that the genocide indictment will be filed has remained the promise on paper, a binding and irresistable promise.

Strengthening P Powers SRK, it's also a extinguishing promise. This prosecutor has been allocated a budget for few positions for prosecutors and several support staff. The results in handling war crimes are negligible.

The executive's inadequate interventions and legislature in the independence of fair courts and the Constitutional Court. The ruling party is the champion to improperly intervene in independent institutions. Reports of the Council of Europe experts have treated the Government's interventions against prosecutors and individual judges as well as the justice system as worrying. This is unacceptable for a state that aspires to become part of the Council of Europe.

And all in the end, this government has empowered the culture of intrepidity in the fight against corruption in cases where the official government has faced criminal investigations of corruption. Rarely sometimes, his own prime minister or minister has accused the prosecution bodies when they have arrested or launched investigations of corruption, such as Martin Berishaj, the KEK case, the case of state reserves and many other cases.
