Kurt releases Pee, gives orders to give properties to Decani Monastery

The Kosovo government has ordered the Cadastral Agency to implement the Constitutional Court's decision to recognise the Decani Monastery's right to 24 hectares. At the Government meeting Wednesday, he has said the Government of Kosovo was ahead of two options: To meet this condition and to have Kosovo accepted into the Council of Europe or to remain without membership. According to him, the decision was made “driven by sound reason”. Kurti has said the decision continues to call it harmful, but has added that accession to the KiE would be historic victories.

“Mbi all required a reasonable decision, unfortunately not fair in its capacity. But in spite of this to achieve a very large goal that we owe to the state that opens unprecedented opportunities, we must step forward with caution and responsibility as an independent and sovereign state. So today we have told Kosovo's cadastral agency to implement the Constitutional decision, while Foreign Affairs Minister Donica Grovalla has sent verbal notes to the Council of Europe”, Kurti has declared.

Kurti has said the responsible committee at the Council of Europe General Assembly has also said in the latest report that the condition must be met for membership remains. While saying they have made efforts to remove this condition, Kurti has declared that “are convinced we have to resolve a decision, that there is no third solution”.

As prime minister, we do not like that strange and unfair decision, while there are other pending court processes on the issue as we as legal and legal means and judicial governments to annul the Constitutional Court's decision. I will never change my attitude toward this harmful decision. On the other hand, there is no doubt that Kosovo's membership in the Council of Europe would be not only historic victory, but also a huge step for our Republic towards recognising the five European countries that enable NATO and EU membership for independent Kosovo. In exercising judgment on this matter I have been guided by sound reason. No one has the right to prevent Kosovo from being an equal state to any other continent state. No one has the right to lose citizens the right to feel European citizens having the right to approach the European Court for human rights and dozens of other mechanisms that make up the pan-European diplomatic machine”, he has said.

Kurti has said that on March 22nd the CoE General Assembly Committee holds an extraordinary meeting, and the General Assembly meets in mid-April. In late May it will be the meeting of the Council of Ministers that decides for Kosovo membership or not.

Kreshnik Ahmeti, deputy minister of the Ministry of Foreign Affairs, has said that this criterion has been the only one left to Kosovo since January. According to him, there has been no consensus in the government cabinet either.

The court's case in which 24 hectares of land and forests date from 2000 to 2016, when the Constitutional Court ruled in favor of the monastery.

The Constitutional Court, at the time, rejected the decision of the Supreme Court's Special Chamber Appeal College of 2015, to return the subject to the Constitutional Court in Decan, and found that the previous Supreme Court's decision in 2012, which confirmed ownership of the Monastery on opposing land, is to be tried by a formal form.

About three years ago, the Constitutional Court stated that its decision is not being implemented. In this decision, the Constitution stresses that it has no jurisdiction to assess responsibility for failing to discuss a verdict by the responsible bodies, but that such an assessment belongs to the State Prosecutor, in accordance with the Criminal Code and the Penal Procedure Code of the Republic of Kosovo.

The property issue at the Decani Monastery had created disagreements with local authorities in Decani, as well as on the construction of the main Decani-Plav road. Works for the construction of this road were initially developed through the Monastery Protection Zone and have been interrupted several times at the request of the Government of Kosovo and the international community. Meanwhile, about four years ago, a Council consisting of representatives of the Government, the Serbian Orthodox Church and the international community had approved an agreement on building an alternative route.
