On behalf of Dardaphony, we want to express our deepest concern and disappointment over the Justice Ministry's recent decision to suspend the Private Master, who was elected by the Ministry itself to handle the Dardaphony subject. That happens at a time when the court has ascertained that this owner has not committed any violations of the procedures or laws in force.
The act of suspension of the owner, deliberately chosen to address a sensitive and important issue such as the Dardaphony subject, shows not only a clear violation of the principles of the independence of judicial institutions but also an unprecedented political interference in judicial decisions and the functioning of independent institutions.
The justice ministry's action, which comes after a long period of refusing to allow the execution of Dardaphonic's course in international arbitration since 2016, raises serious doubts about government efforts to intervene directly in certain cases of international arbitration, thus undermining the integrity and independence of the justice system in our country.
Dardaphony requires that the Ministry of Justice and government institutions be made transparent in their actions and stop any kind of intervention affecting the rule of law and independence of the judiciary. We stress the urgent need to respect judicial decisions and support the impartial and independent functioning of justice institutions as the main pillar of functioning of state and law and the system of democratic values, which the Republic of Kosovo is recognised and established.
Dardaphon calls for the immediate return of the magistrate to his task, to enable the execution of judicial decisions, as guaranteed constitutional right under the right to fair judgment, for all citizens and subjects in our Republic. We reiterate our readiness for co-operation with all institutional instances to ensure a fair and legitimate solution to the issue in question, protecting the interests of all involved with the highest dedication to the principles of justice and transparency.
