Over 8 years in prison and over 27 thousand euros in fines against 8 accused of smuggling with migrants

The Pristina Constitutional Court following the approval of the plea agreement between the Special Prosecutor of the Republic of Kosovo (PSRK) and the accused Lutfi Hoxhaj, Riza Hakaj, Femi Hakaj, Selim Kryeziu, Fazli Gashi, Adem Podrimqaku, Eljver Aliji and Agron Meci, has sentenced eight of the accused (with) more than 8 years in prison, and 27 thousand and 800 euros fines for the criminal work <x1komtrafimmmmed with zox2>.
In the act taken on December 8, 2023, under the agreement reached with the SPRK, for accused Lutfi Hoxhaj, Riza Hakaj, Femi Hakaj, Selim Kryeziu and Fazli Gashi, has become requalified of the criminal act by the “organised crime” in the “smuggling” in co-ordination, reports the “Voting for Justice”.
As for accused Adem Podrimqaku, Eljver Aliji and Agron Mechi, criminal acts have remained as in the indictment “smuggling with migrants” in co-ordination.
Meanwhile, for accused Vladan Radomirovic, after the court had failed to ensure the same in the procedure, it had narrowed the case against him, while for the other accused, Florin Dragjoshi, P The SRK has dropped the charge after the same one was sentenced in Croatia.
Under the indictment, accused Lutfi Hoxhaj was sentenced to 13 months and 18 days in prison and 10,000 euros in fines. Indictee Riza Hakaj was sentenced to 13 months and 18 days in prison and 6 thousand euros in fines.
To accused Femi Hakaj has been pronounced a prison sentence of 11 months and 18 days and 6 thousand euros in fines, for Selim Kryeziu 13 months and 18 days in prison and 300 euros in fine, for Fazli Gashi 12 months and 28 days in prison and 2 thousand euros in fines.
On the other hand, against Adem Podrimqak, the court declared a 12-month prison sentence and 500 euros in fine, to Eliver Aliy 11 months and 16 days in prison and 500 euros in fines, and to Agron Mechi 10 months in prison and 2 thousand euros in fines.
Under the trial, the above - mentioned sentences are executed within the 15 - day deadline, but no longer than three months after the full might of this act.
The trial is said to be fined, accused could pay up to six installments. In the sentence pronounced in prison, however, the accused will be counted as the time spent under house detention and house arrest.
The indictment is said to remove the bail measure (the location on the mortgage of five cadastral units). Indictees Femi Hakaj are stripped of bail in many of the 20,000 euros, and accused Eljver Aliji is stripped of bail in many of 6 thousand euros.

Also, accused Selim Kryeziu is confiscated from vehicle BMW, a phone and a sim card. While, Fazli Gashi 1,000 and 330 dinars of Serbia. Pacific, seized by VW Golf, a phone and a sim card.
Furthermore, accused Eljver Aliji is said to be confiscated from the Mercedes Benz car, while accused Femi Hakaj has a phone and a sim card.
According to the bias, financial means are transferred to Kosovo's budget, while vehicles and single-card phones are either used by the Government of Kosovo or sold and money is passed on to the state budget.
The accused were also obliged to pay the expenses of the criminal procedure, while on behalf of the judicial pause each of 100 euros and the funding for compensation of crime victims each of 50 euros.
The injured, in implementing the property-juridical demand, were not instructed in civil conspiracy, with the reason that during the trial, they have renounced this right.
In reasoning on the verdict, the Foundation reportedly pronounced the above - mentioned sentences with conviction that they respond to the degree of social risk of the work for which the accused have been convicted, as well as the degree of criminal responsibility of the accused.
And that with the conviction pronounced by them, the purpose of the initial sentence with Article 41 of KPRK will be reached, respectively, to prevent the chief from committing future criminal acts, to conduct their rehabilitation, prevent others from committing criminal acts, make compensation for the victims or community for the losses or damages committed by criminal acts, and to express social judgment for criminal work, for establishing morality and strengthening the obligation to comply with law”, the decision is said.

In the indictment, Lutfi Hoxhaj, Riza Hakaj, Femi Hakaj, Selim Kryeziu and Fazli Gashi have committed criminal acts of organised crime concerning criminal acts of smuggling with migrants. While, Ademi Podrimqaku, Vladan Radomirovic, Eljver Aliji, Florin Dragjoshi and Agron Meci, allegedly committed criminal work in co-ordinating smuggling with migrants.
According to the indictment claim, defendants from the beginning of 2016 to October 27, 2016, have deliberately organised the smuggling of immigrants of Kosovo citizens (mostly minor victims under the age of 18) and other citizens illegally into European Union states, where the largest number of minor smugglers have ended up in the town of Udine, Italy. /Betimy for Justice
