The trial against Smajli was proclaimed by Judge Allton Murseli on Friday, reports the “Justice Trust “.
Smajli was accused of killing his son E.S., in 2022 in the village of Bajcina, Podujevo, on property issues.
Judge Murseli said that for criminal work “heavy homicide”, Smajli is sentenced to 24 years in prison, while for non-licit possession two years in prison. To him, the Court pronounced a unique sentence of 25 years in prison.
In prison sentences, the accused will also be counted as the time spent in custody.
The same is continued with the detention measure until the full might of this act.
The judge also pointed out that the firearm with which the work was carried out is confiscated.
The accused is also obliged to pay the expenses of the procedure, and that is 200 euros for the judiciary and 50 euros for compensation of crime victims.
The indictment was pronounced in the absence of accused Smajli.
In contrast, according to the indictment filed by Pristina Constitutional Prosecutor on December 22, 2022, Naim Smajli about 5 o'clock in the village of Bajcina, the Podujevo municipality because of property disputes, has deliberately deprived his son of life now at the late E.S.
The accused Smajli, according to the indictment, has fired his late son E.S.
With these actions, Smajli was charged by the Prosecutor for Criminal Work “grave murder” by Article 173, paragraph 1, box 1.3 of the Penal Code.
Always according to the indictment, Naim Smajli from the indefinite date of June 13th, 2022, has kept on the weapon of the type “automatic rifle” contrary to the law, an explosive tool, hand grenade, and, with their possession, Smajli was charged with having committed the criminal work “being held in ownership, control or unauthorized possession of weapons” from Article 366, CPRC paragraph 1.
