Murder of 2021 in Mitrovica: The victim, says the surgeon, was given the shell after being removed from his body, but the responsible organs reported

In this case, Leotrim Selimi is charged with grave murder of M.K. and injuries to Behar Halil and is tasked with illegal weapons. While, Bayta Hasani is accused of serious attempted murder and illegal possession, as according to the indictment, he had deliberately begun committing the criminal act of murder against Florim Sadik, which he had not completed, reports the “Justice Betrim”.

Initially, court chairman Fatos Sejijaj announced that at today's trial session, the Rejja surgeon from polylinika “jeta” has been called to clarify about the surgical intervention made to hurt Sadiku.

The Raji surgeon in witness quality said that the foreign body, removed from the patient's body now injured Sadiku, was in metal composition, and that its first impression was that it was prey.

Later, prosecutor Nojazi Reja proposed to the court to order the conduct of a super-expert psychiatricist for the defendant Selimi, arguing that the expert's statement concerning the conspiracy that the accused has committed criminal work in severe mental shock is unconfirmed.

Prosecutor Rexha said we have a site of the same participants, but with two examinations of the defendants distinguishing one with the other, where expert Tahir Bunnjak claims that a strong mental fear existed in the defendant Selimi, even though the injured person had an electric cable in his hand, while the defendant had a weapon.

However, said psychiatric expert Valbona Blakaj of the same Institute, found that it cannot be talked about high-level fears of harming consciousness when a person holds guns in his hands.

The representative of the damaged parties, attorney Asdren Bytyqi, backed the prosecutor's proposal Rexha and added that psychiatric expertise for defendant Selimi is unprofessional, not independent and contradictory with the report by expert Bulnjak himself.

Bytyqi, among other things, said that expert Bulnjaku has claimed that defendant Selimi in mental shock has fallen without his fault and without preliminary preparations, while defendant Selimi has known that, along with three other people, all armed have gone to the damaged facility -- namely, with preliminary preparation and possibly confrontation.

Lawyer Bytyqi said the expert had played the defence role when he said the defendant argues from his personal reasons, where, according to him, it testifies to the invisibility and non-professionalism of expertise.

While the defender of the accused Selimi, lawyer Naser Soopyan rejected the prosecutor's proposal Raja and lawyer Bytyqi, arguing that this proposal is contrary to legal provisions.

Sopjan asked the Court to refuse this proposal, reasoning that the expertise has no contradiction among the experts who have compiled it, since the findings are clear and adapt to all circumstances clarified in judicial considerations.

In the end, the court rejected Procuroit Rexha's proposal for the release of psychiatric super-expertosis for defendant Selimi, while the reasons for the refusal will be put forward in the verdict.

On September 8th 2023, the Constitutional Court in Mitrovica had sentenced him to a unique sentence of 21 years and six months in prison accused Leotrim Selimi, while Bayta Hasani was sentenced to a unique sentence of 7 years and 6 months.

However, the decision, a complaint with the Court of Appeals, had been exercised by defenders of the accused on January 19, 2024 Appeals approved complaints and, according to official duty, has annulled the first degree act and turned the case into retrial.

Otherwise, the Constitutional Prosecutor in Mitrovica on October 28th 2021 had filed an indictment against Leotrim Selimi, Bayta Hasani, Valon Ibishi and Valmir Selimi.

Indictees Valon Ibishi and Valmir Selimi on November 17th, 2021 have been sentenced to 700 euros in fines and prison terms in terms of eight months (each separately) after agreeing guiltyness of illegal weapons and use of weapons or dangerous means.

Indictees Leutrim Selimi and Bayta Hasani had pleaded guilty only to illegal possession, so the court refused this guilty plea and the procedure was set aside against them.

According to point I.1 of the indictment, Leotrim Selimi on February 12th 2021, on the “Bislim Bajgora” in Mitrovica, has deliberately deprived the deceased M's life. K, where after a dispute over workers with the owner of “Proper Pizza”, Albert Beqiri, comes to the conflict between the “Maestros<x> group, Leotrim Selimi, Bate Hasani, Valmir Ibishi, Liridon Selimi, Labinot Selimi, and the group of “Proper Pizza”, Mentor Beqiri, Florim Sadik, Behar Hali and M.K.

According to the indictment, defendant Leotrim Selimi reportedly had pulled out the branding pistol “Crvena Zastava” and shot the victim and struck the right front of the chest and as a result of his dying wounds. On the other hand, the indictment says that the shells also hit Behar Halili, causing serious bodily injury.

With this, it is said to have committed criminal work “heavy murder” by Article 173, par.1, 1.5 of the Penal Code, where the perpetrators are sentenced to no less than 10 years in prison or to life imprisonment.

While, at the point I.2 of the indictment reportedly defendant Leotrim Selimi on February 12th 2021 in Mitrovica on the “Bislim Bajgora” contrary to the applicable law on weapons, he possessed the brandy pistol “Crvenna Zastava”, with a cartoon, which has been seized by police.

With this, according to the indictment, he committed criminal work “retaining, in control, or unauthorized possession of weapons” by Article 366, par. 1st CPRK and in real union with criminal activity under 1st of the device.

According to the indictment point II.1, Bayte Hasani on February 12th 2021, on the “Bislim Bajgora” in Mitrovica, has deliberately begun committing the criminal act of murder to Florim Sadik, which has not been completed.

The charge is said to be following the plea between the “Proper Pizza”, Mentor Beqiri, Florim Sadiku, Behar Halili and M. While, at the point of III.2 of the indictment, defendant Valon Ibishi said on February 12th 2021, in Mitrovica on the “Bislim Bajgora” contrary to the applicable law on weapons used the pistol of the manufacturer “Tukarev”, bringing it out during the conflict between groups and M.K., Mentor Beqirit, Florim Sadi and Behar Halil.

With this, it is said to have committed criminal work “the use of a dangerous weapon or tool” by Article 367, par. 1 of the Penal Code, and in real union with the criminal offense under point III/1.

While at the last point of the indictment IV.1, defendant Valmir Selimi reportedly on February 12th 2021, in Mitrovica on the “Bislim Bajgora” in opposition to the applicable gun enforcement law has possessed the semiautomatic brandic brand gun Eibar Star”, with a clip and three rounds, which is seized by police.
