The European Union has reacted after the Government of Kosovo has recently refused to establish Association on a European draft, calling it a signed document. EU spokesman Peter Stano in a reply said that association is a duty for Kosovo.
“The EU wants to remember that the founding of the ESM is Kosovo's incomplete obligation stemming from the 2013 Dialogue Agreement, the only Dialogue Agreement ratified by the Kosovo Parliament by a two-thirds majority. Therefore, it is a clear legal obligation for Kosovo under international law. Unfortunately, Kosovo has not taken the necessary steps towards establishing it and therefore towards increased protection of the rights of people belonging to non-US communities.
Stano has recalled that according to the 2013 and 2015 agreements, the Constitution for the establishment of the ESM should be drafted and discussed in Dialog. That, according to him, means that each proposal should be discussed with Serbia and the EU mediator and be in line with the 2013 and 2015 agreements.
In October 2023, in an effort to advance the normalisation process, the EU ʹ supported by member states and its partners, such as the US, introduced a European draft state for the creation of ESM based on the best European models and practices, as well. as the legal framework of Kosovo, which both sides have accepted in principle. In its conclusions of December 2023, the European Council welcomed Serbia and Kosovo's <x1-wise preparedness to accept the draft status put forward by EU facilitator”. This is a formal recognition of the document from the 27 EU member states”, Stano said.
The EU has called on Kosovo to move ahead with the establishment of Association/Unibility in line with the EU's Draft Statistics without further delays.
“The EU also wants to recall that the agreement for the Normalisation Road is valid and legally binding in its entirety for both Kosovo and Serbia. Serbia is expected to fulfil its obligations stemming from the Agreement on the Path of Normalisation, in parallel with Kosovo, to move forward with the establishment of the Association based on the European Drift Stattut, in line with the implementation plan proposed by the EU facilitator”, Stano said.
Government spokesman Perpare Kryeziu, in a response to RTV21, has said the European draft state is a document without signing as many other proposals.
