In this regard, the lawyer, Jevdet Smakqi, has been declared.
According to him, compensation of war victims under the Kosovo Specialised Chambers' order in Shala's case appears to be incompatible even because of actual circumstances, but also judicial circumstances.
“Pjetr Shala has not yet been found guilty with fair justice, so no legal means have been exhausted by bias, nor by extraordinary means at the Supreme Court of Specialised Chambers, nor at the Constitutional Court of Specialised Chambers. Given the fact that Peter Shala was a former member of The KLA is still considered innocent because it has not completed the complaint review procedure for the victims' compensation can not find support for implementation until the act on Peter Shala assumes the formal form. The Special Chambers have considered the serious financial situation for Peter Shala himself to compensate the victims at that height of 208,000.00, so that they have appointed a judge to submit the order with suggestions for the Republic of Kosovo to issue laws on this issue and determine the programme for compensation of war victims, space this empty legal space, which makes almost impossible the execution of the order from the Peshter Shala as well as the Republic of Kosovo<1>.
“L-036 articles 23, article 29 Article 14 and Article 30 does not include victims of war crime 1998 and 1999, so there is no time jurisdiction. So in my view this order to Peter Shala remains only on paper currently”, he is expressed.
