According to Gashi, the Parliament has voted on an issue that was not included on the agenda.
At the last session of the Kosovo Assembly, a serious constitutional and procedural violation has been recorded. Contrary to the established rules and the Kosovo Constitution, the Assembly has voted on an issue that was not included on the agenda.
The regulation of the Kosovo Assembly makes it clear that any changes to the agenda should follow a clearly defined procedure in Article 53 of the regulation, which includes:
- Proposal and voting for lifting or meeting issues on the agenda by parliamentary leaders or at least six deputies;
- Support by 2/3 of the deputies present for adding a new case, or other separate procedures for urgent issues.
In this particular case, the Assembly was called to discuss only one issue of the agenda: the review of the budgetary division bill for 2025. The change of the agenda has not been realised under the regulation, and there has been no vote required by MPs to approve this change.
The move is in direct opposition to the principle of rule of law and rule of law, guaranteed by the Constitution of Kosovo. Any action of the Parliament that does not respect official regulations and procedures violates principles of transparency and judicial security for MPs and citizens.
This precedent endangers the integrity of the decision-making process and weakens public confidence in our democratic institutions. Strict law enforcement and enforcement of procedures are fundamental to maintaining a fair and functional system in the Republic of Kosovo.
