Even in the retrial, former LDK leader in Drenas charged with money laundering is convicted

Statement of the trial for the case was made Monday by the chairman of the court, Violet Namani-Hajra, reports “Justice bet”

Under this indictment, accused Bedri and Albian Nica in co-ordination committed criminal work “The release of money” by Article 302 concerning Article 31 of the Republic of Kosovo Criminal Code, concerning Article 56 paragraph 1, subparagraph 1.1 and 1.6 of the Law to Prevent Money Laundering and Combating Terrorism Financing.

Against defendants Bedri Nica the court has rejected the charge of the “Blerja, acceptance or hiding items taken in the conduct of criminal work”, after the Special Prosecutor's Prosecutor at the conclusion of the trial review has been dropped.

The trial chamber, based on Article 356 paragraph 1 subparagraph 1.2 and paragraph 2 of the Penal Procedure Code for the sentencing of the accused, has scheduled special hearings on this case.

The Constitutional Court in Pristina on April 14, 2023, had declared a court sentence condemning accused Bedri Nica to one year in prison and 15 thousand euros fine for criminal work “money laundering”, while having released him for criminal work “bribing, accepting and hiding items obtained by criminal work”, while accused Albian Nika for criminal work “for preparing” had sentenced him to 6 months in prison and 5 thousand fines.

The Court of Appeals, on the other hand, had confirmed the Act of Foundation Court in Pristina.

While the Supreme Court of Kosovo had found that the court's act of first degree was not compiled based on legal provisions, since both the device and the reasoning do not contain proper clarifications regarding “criminal activism”, considered the essential element of the criminal work figure for which convicted Nika was convicted.

According to the same indictment it is said that the essential violations of the penal procedure provisions that are included in first and second degree judgments are of that nature that have not been able to be avoided by the Supreme Court of Kosovo, so the same have been the reasons why this criminal case is forced to be retriald in the first instance court that must make a fair, legal and reasonable decision on any point of judgment,

According to the indictment filed on December 20th 2021, Bedri Nika was charged with criminal acts “Blerja, the admission and hiding of provisions taken in criminal work” and criminal work “Money Laundering”, with which the accused Albian Nica was also charged.
