The Constitutional Court in Pristina has approved the indictment of journalist Ridvan Berisha against Kosovo Radio (RTK), thus cancelling the latter's decision, through which the plaintiff has been pronounced disciplinary action “The latest written statement”.

On the other hand, the decision says that in the case of the pronunciation of disciplinary action against employers, the employer must generally observe legislation in effect.

Initially, the verdict reportedly says that journalist Berisha, through his representative, had filed charges in court, demanding that the indictment be approved as a whole through which approval be annulled as illegal “The latest written statement”.
Meanwhile, RTK through its representative has provided answers to the indictment, as well as during the judicial reviews, has clarified that the decision to pronounce the disciplinary measure “The recent written reference” has also been linked to evidence.
And so, RTK has rejected Berisha's claims, over that the recent written “move, is easy because according to RTK's regulation, this measure is a serious disciplinary measure, which is pronounced for serious violations of tasks.
The court has found RTK's claim unequivocal for the indictment's claim to have been submitted out of date, since according to the court the deadline for presenting the indictment has begun to flow from April 28, 2021, the date until the side has had the right to file complaints within RTK.
The court has found, among other things, that the disciplinary measure pronounced against Berisha is completely disproportional to the alleged violations, since with RTK's internal act the other move is envisioned before the latest remarks are pronounced.
Similarly, the court has found RTK on the case of the pronunciation of the latest disciplinary measure of remarks. Against Berisha, there are only descriptions of alleged violations by not reasoning at any point in what way it has come up to ascertain alleged violations.
This ruling by the Pristina Constitutional Court is taken on October 14th 2024, in which the right to complaint for disgruntled parties in the 7-day term is envisioned.
Otherwise, in the indictment filed on May 31st, 2021 by Ridvan Berisha reportedly with the RTK Disciplinary Commission's decision, he had been held responsible for serious disciplinary violations, implicating disciplinary measures, the latest written remark.
Always according to the indictment, to this RTK decision, Berisha had filed complaints, but that the commission had not decided on the complaint and kept silent.
The indictment reportedly states that the verdict of indictee (RTK) has been issued in violation of the disciplinary procedure provisions for the fact that Berisha has not been handed over invitations to the session and that he has not even been handed over to the paper for the start of the disciplinary procedure.
Also, according to the indictment, the Commission, which has pronounced the disciplinary warning, has not been in regular composition, as a member of the commission's composition committee, Liridon Dalipi, and two members Albert Ademi and Zana Sejdiu did not attend the session.
