Former prosecutor Syla Hoxha, speaking of the 42 persons trial process charged with the terrorist attack, occurring on 24 September 2023 in Zvecan Banjsk, has said terrorists, including Milan Radojcicin, accused of terrorism, could be tried in absentia.
Hoxha has stressed the need for meeting the envisioned conditions in Article 303 of the Criminal Procedure Code, ensuring that all procedures will be carried out without obstruction and in accordance with the law.
“Yes, just because they have to observe the provisions of Article 303 of the Criminal Procedure Code, and all those pre-precedented provisions, some” must be met, Hoxha said at RTV Duguagjini.
“Now, with this code, we have no obstacles to developing into normal and unimpeded procedures, and without dilemma”, the former prosecutor added.
Hoxha also stressed the quality of the Special Prosecutor's Act, stressing that the investigation and preparation of the case were completed in a record term, taking into account the complexity and seriousness of the case.
It's also quality for content. I've said it was over in a record term, given the complexity and seriousness of the case, as there were many involved. Co-operation with the neighbouring country, where most of the accused live, has been lacking. As well as the state prosecution had to send many experts abroad to wait in the absence of certain labs in Kosovo”, Hoxha has added.
The Supreme Court has done its job, and I believe there is no reason to complain in the Supreme. Since the code of procedure is quite clear, and the judge alone, as well as the chairman of the court, must meet certain criteria that I believe the prosecutor has fulfilled before establishing the indictment. Those measures, calls, arrest warrants, internal arrest warrants, and international ones, so that there are no obstacles to”, Hoxha has further said.
We remember that 45 people in charge of Milan Radojciqi are charged by the Special Prosecutor for carrying out terrorism and heavy action against the constitutional order and security of the Republic of Kosovo.
