Tax inspector Fidan Tolaj has said that ATK has imposed tax duties on Sinan Vlasaliu based on information from the posts of music clubs on social networks where the singer had to perform.
Inspector Tolaj has handed this statement in judgment Thursday against singer Vlasaliu, who is charged with damaging the state 24 thousand and 270 euros and 98 cents, avoiding taxes.
Tolaj has declared that these clubs within Kosovo have also been inspected by the Kosovo Police, while for those abroad, they have had no information but the mailers they posted on social networks.
During this session, the ATK inspector testified about investigations and inspections that ATK had made about singer Sinan Vlasaliu for his tax obligations, adding that any entry should be declared in ATK even if taxes are conducted abroad.
Tolaj, among other things, has highlighted the fact that accused Vlasaliu has not brought testimony to the declared incomes in America, even though the same man had said he would.
Responding to the prosecutor's question, Elza Bajrami, witness Tolaj said the criminal outcry that was exercised by ATK has been handed over to the prosecutor with evidence attached.
However, in the concrete case, the final report has not been compiled by ATK, as according to Tolaj, during the investigation phase were announced by the prosecutor in the case that the plea agreement with Vlasaliu has been reached.
Vlasaliu's defence lawyer, Florent Latifaj, rejected the inspector's statements after the same one said ATK has not drafted the final report as necessary.
Latifaj has said that Inspector Tolaj has not provided accurate answers when asked why this final report has not been drafted.
Also the inspector's reasoning that I don't know how much the singer Vlasaliu has been paid for the nights he's been singing in the diaspora, but has released an average based on club posts, according to him, this is not allowed in criminal law because any extraction of the average has had to be interpreted at zero value, not two thousand euros.
This was after Inspector Tolaj said that singer Vlasaliu's average incomes for the nights he has sung have come out based on his claims that he receives about 2,000 to 2,500 euros.
And I'm also based on his statement we interviewed, the same guy said that somewhere around 2000-2500 euros, we took this average, then those publications that were made, we calculated that we received 2000 euros in the night”, said Tolaj.
Among other things, Inspector Tolaj said the taxpayers in the case of Sinan Vlasaiu is being presented as a regular payment for 2011-2013 and for the following years 2014-2016 lack these statements.
“in 2016 cannot be regular declaration, this indicates that the taxpayers have not declared tax at all for 3 years”, Tolaj said.
After these statements, the court has approved the defence proposal for the appointment of financial expertise in the case, which the prosecutor Bajrami has supported, as well as the authorised representative of ATK Youth Arifi has supported.
Under these circumstances today's session is over and the next one will be assigned after taking expertise.
Otherwise at the beginning of the session attorney Latifaj has demanded that he and his defender, Sinan Vlasaliu, not be photographed by the media present, but, case judge Naim Krasniqi Yashanica has refused such a request with the reasoning that the hearing is public and that photographing and recording are allowed.
Prosecutor Elza Bajrami's proposal was approved last session, in which case the witness will be heard by the tax inspector of Kosovo Tax Administration (ATK), Fidan Tolaj, in which singer Sinan Vlasaliu is charged with damaging state 24 thousand and 270 euros and 98 cents, avoiding taxes during 2011-2015
The accused Vlasaliu was declared innocent at the session held on November 18th 2022.
